i don’t mind your posts at all, dividendchaser, all entitled to their own
opinions and for sure aviva sp has not been kind to investors for a fair
old while. but may i ask, given your very gloomy take on the company,
are you still holding your shares in aviva, and if so why? - thousands of
other shares (/bonds etc) out there to choose from, so if you have no
confidence in aviva’s chances, would it not make more sense at this point
to sell your holding & buy into something you think has better prospects?

hi bill, the puzzlement i expressed at 12:20 is about posters’
positive reactions to the *last* RNS, i.e. the one at 30th april.

i can see why some posters would have found comfort in
some parts of the update RNS on 9th april, as i think they
tried as hard as they could to dress up the unpalatable news
of the nomad’s resignation by tucking it away towards the
bottom of other more upbeat comment about the company.

but the 30th april RNS was more stark and simple.

hi aubrey, yes, the *absence* of facts about things where
one would expect some is also reasonably something that
a person could take into account in forming their opinion.

in that vein, it is remarkable how little EUA has
explained so far re ‘relationship’ with CITIC ...
telling the market which section they’ve been
trying to talk with doesn’t really clarify much.

i am puzzled why so many people on this board
thought that the last RNS was a positive one.

seems to me that early in april they RNS’d to say,
‘oops, our nomad has resigned, but we’re talking
to another one and we believe they’ll take us on
by the end of april.’ then the second RNS says, ‘our
original nomad has now left the building, & we were
wrong about another one taking us on by the end of
april. however we are still trying to persuade them.’

people seem to be reading a lot into differences in
wordings about whether discussions are happening,
advanced discussions are happening, or really really
advanced discussions are happening ... & also seem
to be taking it for granted that if someone does due
diligence on EUA, that the outcome of that will be positive.
- i suppose it might be, but that’s an optimist’s assumption.

(the other big reason why cases are often not brought, or will settle
early, is because of the need for full disclosure of all relevant material
in advance of hearing, which means that parties are *obliged* to reveal
*all* material which could potentially harm their own case. that deters
a lot of potential litigants, who don’t want their dirtier laundry to be aired.)

i think what he has said before is that his opinion is based upon
the publicly available facts of share price movements, content of
the published RNSs, and the content and style of posting & tweets
by enthusiastic supporters. he’s not been claiming that he has facts
which would necessarily prove it to others, as would be required for
someone trying to sue or prosecute a company in the courts. defence
#1 for someone like this would simply be that he has been expressing
his own honest opinion without malice, with it being an opinion that
other reasonable people might also come to hold, whether or not the
opinion eventually turns out to be mistaken. the two other main lines
of defence in English courts could be #2 contend that no serious harm
has resulted from his actions, or #3 the simplest defence, that of truth.

the ‘own honest opinion’ defence tends to be a pretty strong & resilient
one. although on the downside for both sides, costs escalate rapidly,
with libel cases being notoriously expensive, so many cases will settle.

hi alan, a nomad doing due diligence is a bit like someone conducting a survey
of a property that are thinking of buying. i.e.. whether or not that person proceeds
to actually buy the property depends at least in part on what the survey reveals.
(so sometimes the findings from the survey become the reason a deal falls through.)

given that this company is under some scrutiny regarding social
media speculation issues, & they have not yet persuaded another
nomad to take them on, it would be absolutely crazy for someone
who really is an insider to co-operate with any leaks at this stage,

Wmsjames, i posted before that they would run out of cash around
Easter unless they raised new money through yet another placement.
as it turned out, they were unable to get any placing away, so had to
resort to that awful loan arrangement to keep the lightbulbs on. but
i was pretty much bang on about when their cash would run out.

Adrianuk, what would this company use to buy more assets?
they are struggling to scrape together even that deposit.
