This sounds a reasonable argument on the surface, but is it??
This suggest the lawyers shift all the risk to the insurance company, as in heads the lawyers don't lose, tails they win big. However, for the insurance company it's head I lose, tails I win.
In this scenario, any sophisticated insurance companies will ALSO do due diligence, to stack the chances of them making money in their favour, and by that they would also have good expectations that the lawyers will win the case, and that they do NOT pay out.
So we are back again to the expectation that the lawyers ''will win'' the ICSID case.
