It isn't about whether it is published or not. It is about the scope. SNG need to have a patent in order to sell anything, this is what they will be selling (and perhaps their current stock, but that's not where any value comes from). These are the FTO patents. If carefully crafted they do get published but have zero value in protecting from copycats, even if specific claims that seem protective are actually published. Literally anyone can make something indisnguishly similar and sell it in the same market and SNG will do nothing about it, because if they do try to enforce they will end up losing their own patent. Ifnb, including nebulised for respiratory diseases/conditions has been around for decades. In fact has been failing to make a breakthrough for ages. If somehow someone finds a way to make it useful, others will join in no time and SNG will not be able to do anything about that, except try to sell their own version of it.
