However, the country is waiting for key projects related to green transport. A final decision has still not been made on whether lithium will be mined in Cínovec in North Bohemia with regard to battery production. It should be clear during this year. It is therefore possible that after eight years lithium will again be an election issue. Above all, however, unlike neighboring countries, the Czech Republic does not have a project for a battery factory for electric cars, the so-called gigafactory. The German concern ultimately cancelled the considered construction of a Volkswagen plant near Pilsen. There is also uncertainty surrounding the project in the Ostrava region, where an Asian company, not yet specified by the government, is interested in construction. However, uncertainty has been introduced into the investment by the current situation on the electric car market, which, contrary to previous assumptions, is less interested in. However, Minister of Transport Kupka indicated that that negotiations on the construction of the factory may be progressing in the right direction: "We are working on supporting the gigafactory so that the conditions for it are in the Czech Republic. And hopefully it will soon become clear that the Czech government has stood up to it, and we will be able to produce batteries in the Czech Republic. And this is important both for the production of electric vehicles and the production of capacity storage." However, he did not specify details about when a decision could be made on the construction of the factory.

The government meets on February 19, but Cínovec is not on the agenda, perhaps next week.

The Ústí nad Labem Region considers the documents submitted by Geomet regarding the lithium mining project in the Ore Mountains to be insufficient. It is necessary to add a specific description of the technology for treating the mined ore, Governor Richard Brabec (ANO) told reporters today, who wants to revive the lithium working group so that citizens have more information about the project.

Dear fellow citizens, dear friends of the city of Dubí...

In recent weeks, the topic of lithium mining and processing has been gaining momentum, because in accordance with the Environmental Impact Assessment Act, the intention to establish a "Plant for the processing of mined ore from the Cínovec deposit, including a transport system", has been announced. The intention announcement contains some details about transport, such as the fact that the ropeway/material cable car should be in operation 24 hours a day, 365 days a year, and the point of break will be located in the Střelná cadastre, on the road between Dvojhradí and Košťany Chateau, approximately 130 meters from the nearest development in the Dvojhradí locality. In the Dukla area, the material will be dumped on an open dump, which may lead to higher dust levels in the area depending on wind flow. The intention announcement does not answer the question of noise. From Dukla, 10-14 trains with 22 wagons should run daily between 6 am and 10 pm, which will also line up at the Teplice – Lesní brána and Oldřichov – Jeníkov stations. The transport system itself includes 20 towers with a height of 32 – 51 meters, depending on the variant

above trees or in clearings, the construction of which will require deforestation, including in the planned 1st zone of the future Krušné hory PLA.

The public, the affected public, the affected authorities and the affected territorial self-governing units can send their written comments on the notification of the intention to the Ministry of the Environment of the Czech Republic within 30 days from the date of publication of the information on the notification of the intention on the official notice board of the Ústí nad Labem Region. The city of Dubí and the building authority also sent their comments on the intention, not only on the above-mentioned facts.

5. Deficiencies in the identification of exclusive deposits in the list of § 2, paragraph 3 letters a) to d)

We request that the identification numbers of exclusive deposits be supplemented by the identification of the records in which these numbers are kept or the legal acts by which they were assigned. If the content of the proposed government regulation is to be based on a list of references to previously issued individual legal acts, which are thus included in the legal system as reference references, these references must be in a specific form. We further propose to amend the exclusion of the possibility of subsequent changes to the definition of the area of ​​a deposit of strategic importance through an individual administrative act relating to any of the listed exclusive deposits from the point of view of the content of the proposed government regulation (see the general comment above).

This comment is essential.

The government regulation is not to determine the area of ​​a deposit of strategic importance, but a deposit of strategic importance.

6. On the superfluous provision of Section 2 paragraph 4

With regard to the definition of the area of ​​the deposit of strategic importance Cínovec using references to the listed exclusive deposits [Section 2 paragraph 3 letters a) to d)], which are, among other things, the subject of registration in the information system managed by the Czech Geological Survey, the determination of the “graphic representation of exclusive deposits within the borders of the protected deposit area Cínovec” appears to be unnecessary and it would be sufficient to simply state it in the justification of the proposal.

It should also be pointed out that the proposal does not take into account the possible conflict of the “determination of the graphic representation…” according to Section 2 paragraph 4, or Annex No. 2 of the Regulation, and the delimitation of the territory of the listed exclusive deposits by individual legal acts (made ex ante and ex post).

We demand the deletion of Section 2 paragraph 4 and Annex No. 2.

1. On the draft government regulation (title)

In the title, we recommend inserting the word “GOVERNMENT” after the word “REGULATION”.

2. On the justification (p. 3, bullet Reimbursement from extracted minerals)

We recommend clarifying whether the rate stated here (10,692 CZK) is intended for 1 kg or 1 ton of extracted lithium. The wording is unclear and allows for different interpretations

B. On the individual provisions of the draft

1. On the title of the legal regulation

The draft government regulation uses the phrase “in the Cínovec area”, which does not correspond to the text of § 1 or § 2, paragraph 1.

The draft needs to be stylistically unified.

3. Deficiencies in the identification of the Cínovec protected deposit area in § 2, paragraph 1

We request that the identification number of the protected deposit area be supplemented by the identification of the register in which this number is kept, or the legal act by which it was assigned, as this is essential information for the entire content of the proposed government regulation. If the content of the proposed government regulation is to be based on a list of references to previously issued individual legal acts, which are thus included in the legal system as reference references, these references must have a specific form.

This comment is essential.

There should be a comma after the number 12370000.

4. Non-normative provisions of § 2, paragraph 2

According to § 2, paragraph 2 of the proposal “Annex No. 1 to this regulation establishes an indicative graphic representation of the Cínovec deposit of strategic importance”. The cited provision is in conflict with Article 39, paragraph 1 of the Legislative Rules of the Government by a non-normative provision (see “… establishes an indicative …”).

With regard to the definition of the area of ​​the Cínovec deposit of strategic importance by means of references to the listed exclusive deposits [§ 2, paragraph 3, letters a) to d)], which are, among other things, the subject of registration in the information system managed by the Czech Geological Survey [Raw Materials Information System (SurIS), or Geological Information System (GeoIS)], the “establishment of an indicative graphic representation of the deposit…” is unnecessary and it would be sufficient to simply state it in the justification of the proposal.

We demand the deletion of § 2, paragraph 2 and Annex No. 1.

The company Geomet, which is exploring the lithium deposit under Cínovce in the Ore Mountains, has published details of the ore processing plant, including the transport system. It continues to plan to transport the ore by belt conveyor or cable car, both of which will require the construction of masts above the treetops or in a forest clearing. The system will be in operation continuously. From the transshipment point in the Teplice region, the ore will be transported by rail to the site of the former brown coal power plant Prunéřov in the Chomutov region. ČEZ wants to decide whether to mine it by the end of this year. The processing plant has a capacity of 3.2 million tons of ore per year. The main goal of the project is the production of lithium carbonate for battery production. Some by-products may also be produced. The ore will be transported from the mine by belt conveyor or cable car with trolleys to the Dukla industrial complex in the Teplice region. The ore will not be unloaded between 10:00 p.m. and 6:00 a.m. From there it will be transported to Prunéřov, 60 kilometers away. The residual material will be stored on the territory of the Nástup Tušimice Mine. The ore will be crushed in the mine. The towers for the conveyor or the cable car masts will be approximately 50 meters high, or half that if they do not pass over the treetops. The environmental impact of the project will only be assessed during the so-called EIA. The route crosses a number of valleys, bridges a road, and spans water bodies. Some locals fear that it will have a significant impact on the landscape character of the affected part of the Ore Mountains. Geomet is planning a transfer point in Újezdeček between the closed Teplice - Lesní brána railway station and the Dukla settlement. Originally, a processing plant was also planned here, but locals strongly opposed this and the miners then changed the location. Geomet, whose majority stake is owned by Severočeské doly, a company belonging to the ČEZ group, wants to focus in the next stages of preparation on refining technical, economic and environmental details, which will serve as the basis for, among other things, an environmental impact assessment. The published documents show that 500 people could work in the processing plant in Prunéřov, and 100 in Dukla.
