We know from the court docs that Tremor's Alphonso data was replaced with Fourthwall Media...
PeerLogix and FourthWall Media® Partner to Unify Linear and Streaming TV Audiences
November 7, 2018
Linear and Over-the-Top (OTT) television measurement innovators combine viewership data pools on over 25MM households to power unique analysis and activation opportunities leveraging patented, privacy-compliant collection and matching technologies, the blended data set represent approximately 25 million homes in North America. This new partnership offers programmers, agencies and advertisers unique tools to analyse, plan and optimize their programming and advertising strategies cohesively, across a fragmented landscape.
FourthWall Media® is widely recognized as the original collector of television viewing data, and the provider of the cleanest, most well-behaved viewing data available: processing 12 MM households in the US, resulting in a household addressable reach of 121 MM, and over 400 MM Connected TV devices.
We collect and process billions of viewing events every day from millions of matchable homes, and feed that data into Reveal, the most powerful and elegant TV analytics platform available. All of this is so our partners and customers in the TV and media ecosystems have the right tools to gain insights, leverage their knowledge, and grow their businesses.
Peerlogix is the recognised leader in the global OTT data-as-a-service space. The company tracks viewership data of more than 50,000 premium TV and movies across more than 180 million households as streamed from virtually every open-source OTT network globally… Https://www.peerlogix.com
For those of you debating the value of the Alphonso TV data to Tremor, here is an extract from the court case script…..Lawyer for the defence, Mr Bruce said, ….and we know now, because we have the FourthWall/Tremor Agreement. FourthWall is not contractually obligated to supply Tremor with LGE data. FourthWall's obligation is to supply a minimum daily average of households, but with a viewership data from any source and to the parties, Tremor and FourthWall, specifically negotiated with both of them aware that the LGE data was going to disappear at some point.
Once again I repost this...Sequesters enlightens you … TRMR still have data from Fourthwall; both Fourthwall and TRMR are now missing LGE data. FourthWall are leaders in the field, and additionally have a data pooling partnership with PeerLogix. PeerLogix (OTC: LOGX) is the recognized leader in the global OTT data-as-a-service space. The company tracks viewership data of more than 50,000 premium TV shows and movies across more than 180 million households as streamed from virtually every open-source OTT network, globally. TRMR will be missing a small portion of a small data mart, from a data warehouse. Meanwhile back in the realm of fact. As I stated in a previous post, Perion share price rose 35% on a single day. And logic says TRMR will beat their results.
Those persuaded by negative posting here should read the full contributions on advfm stretching back over the past three days.If Alphonso was so valuable, why was it surviving on borrowed money from Tremor? Yes, that will come as a surprise to many. We know now from the court docs that the Alphonso data was replaced with Fourthwall’s. It was only the LGE data that was stopped by LG. …. Courtesy, sequesters who enlightens you on advfm… TRMR still have data from Fourthwall; both Fourthwall and TRMR are now missing LGE data. The nagging inuendo equating the Alphonso case to a revenue hit for Tremor is being worked by some and needs to be put to bed. Unless your motives extend beyond common sense, there is no good reason to suggest that the loss of a single data point and (at worst) a few % points in revenue, is going to have any meaningful impact on a company that is growing at c. 20% -30% per year. I fully expect this will be confirmed in the 11th November call, at which point all this litigation malarky should be buried until it is resolved between the parties, one way or the other, in or out of court. Either way, it looks to me that Tremor has a substantial award coming to it.
Another correction... LG owns Nielson/Greenwall and the data...that should read, LG owns Nielsen/Gracenote and the data. Apologies , but it is Saturday night and I like a glass or two/three.
Tricky, if you do decide to visit advfm you would need to start with the post from midasx at 10.15hrs on the 27/10/21 on page 797, and work forward from there.
Correction...so can’t cover the agreement/contract tangle again here.. That should read...so you can cover the agreement/contract tangle over there.
Tricky, LG owns Nielson/Greenwall and the data and this case is way more complex than just the loss of the LG/ Alphonso data feed to Tremor. There are issues relating to unpaid loans, the reimbursement of overpayments for services to Tremor and the alleged damage to Tremors business from the misuse of Tremor’s sensitive information by Alphonso after it was acquired by LG. I, along with others, have spent a lot of time posting up on all this, on the advfm bb as brimach1, so can’t cover the agreement/contract tangle again here. If you are interested, you will get a much better handle on all of this by going over there and tracking back to when this issue was first raised, about two days ago. Warning….there is some serious crap in between the more informed post on advfm. If you really want to understand this case and its history, you will just have to navigate your way through the garbage. Be prepared for a lot of reading. Best of luck.

I don’t think it is just about the Tremor Vs. LG/Alphonso court case, per se. Rather, people are trying to reconcile the impact (or not) on 3Q earnings and more so, on 4Q guidance, in the light of the claims therein by Tremor, that it has been damaged from the actions of LG/Alphonso, from the cutting off of the LG TV data supply in September, in breach of the contract they had with Fourthwall. On the advfm bulletin board, over the past two days or so, there has been quite a lot of debate and analysis of the court documents etc. Not recommended if you have no interest in this topic or if you are a light reader or if you cannot take the carp from some of the crap artists that post there.

Thanks again Digi. I spent a couple of hours digesting the content of that link. Fascinating stuff and complex at the same time.
In regard to Tremors RTO (Injunction), I was encouraged with the Judges summing up of the status quo. He said,…Again, I'm putting aside the fact that there may be a claim that all of these breaches could give rise to liability for monetary damages down the road. These are issues that will have to be litigated. The evidence on this record suggests that Tremor is likely to succeed on the merits of its claim that Alphonso used Tremor's confidential information in violation of the parties' Agreement, and it seems pretty clear to me that it was misused or at least based on the record I have there's a likelihood that it was misused.
I can see that Canute is posting on this thread but as you all know I have him filtered and so, I never read his clap.
The claims against Alphonso (and LG) are long and multiply damning. If proven culpable then the duplicit Corporate behaviour here is nothing short of disgraceful and utterly contemptable.... It’s my view therefor, that the accused parties will not take this case to the wire and so, it will not come as a surprise to me to hear that the case against Alphonso/LG, has been settled out-of-court in Tremors favour. It will likely carry the usual perfunctory media muzzle to restrict disclosure and further Brand damage to the assocciated parties, of course.
The forward guidance for 4Q should guide us as to what extent Tremor has managed to mitigated against Alphonso’s behaviour. Which, on the face of it, is breathtakingly shocking.
If/when Tremor succeeds in obtaining damages, Alphonso’s and LG’s reputation (the Brand) could suffer detrimental damage within the adtech space where such news travels quickly. The ‘immediate’ impact on Tremor may not be classifiable as ‘materially significant’ but accumulatively, the past, present, ongoing and future damage done to Tremor, assuming it can actually be quantified rather than subjective, may well be significant, in which case, if everything claimed by Tremor in these court docs is proven, then the quantum awarded to Tremor could be substantial and then add to that the alleged $11million owed to Tremor by Alphonso. The forward guidance for 4Q should guide us as to what extent Tremor has managed to mitigated against Alphonso’s behaviour.
When you read this document in its entirety you are left asking yourself the question, Corporate crook or what?

RNS 19th Dec 2019….. Alphonso has been providing Tremor Video with television viewership data for the last four years and has agreed to a two-year extension. Tremor leverages the data collected by Alphonso, whose viewership data reach includes 15 million opted-in U.S. households. ….Not a lot.
RNS 26th October 2021…Tremor Signs Exclusive Global Smart TV Data Partnership with VIDAA. Smart TV base expected to grow from 20 million to c. 40 million, significantly extending Tremor's global reach.
The partnership enables Tremor's technology platform to gain exclusive access to VIDAA's automatic content recognition ('ACR') data, both in the US and internationally. Tremor will bring VIDAA's ACR data into its TV Intelligence solution starting May 1 2022, providing exclusive rights to the VIDAA ACR data in all global markets, and Tremor will activate in the US, Canada, UK, Germany, France, Italy, Spain, Portugal, Netherlands, Australia, and Japan.
Knowing what you know now about Alphonso which of the above TV data providers would you prefer.
What is the impact of all this in the intrim. Tremor gave its revenue guidance for 3Q along with the 2Q results. All we can do is wait.
88 Extract F. Alphonso’s Refusal to Repay Tremor…..
On February 23, 2021, Tremor sent Alphonso a letter setting forth the numerous breaches of contract Tremor was aware of at the time. The letter also itemized and requested prompt payment of the significant amounts that Alphonso owes to Tremor. In particular, Alphonso has not repaid any of the $6,500,000 that Tremor advanced or the $750,000 in associated fees under the Security Agreement, all of which became immediately due upon termination of the Agreement.
89. Alphonso also owes Tremor $1,875,000 in Fee Credits arising out of Tremor’s overpayments in 2019, as well as the $2,000,000 in fees that Tremor prepaid during the second half of 2020. 90. All in, Alphonso is required to remit $11,125,000 to Tremor in connection with the termination of the parties’ relationship. Alphonso, however, has refused to do so—illegally holding hostage over ten million dollars of Tremor’s own money.

Brought over from advfm. Alphonso case docs. Interesting that Tremor had to provide a loan for Alphonso when Alphonso got into financial difficulty. Hard to believe then that Alphonso was being peddled as the market leader in providing brands and agencies with verified TV audiences...Extract...In furtherance of this partnership and in light of their longstanding relationship, Tremor later advanced Alphonso $6.5 million in the form of a loan secured by all of Alphonso’s assets and more than $4 million in prepayments to help Alphonso when it experienced financial difficulties....Brings Alphonso into a totally different perspective. A two-bit Co, comes to mind. Success for Tremor here could result in a very substantial settlement for Tremor. Canute will have an apoplexy.

severnof9..In response to Digis question. I am a UK lawyer and having read the notice of discontinuance I think I can answer this question. Hi wheeze,I’m glad the documents are now on the bb,s for discussion? Re your...My question would be Alphonso don’t have a pot to p*ss in and any compensation would have to come from the deep pockets of LG,my question would be according to this document the last document posted at the NY Supreme Court both parties have agreed liability will not be knocking on LG,s door?....hopefully someone with more knowledge would better explain?

The parties to the litigation were: Tremor Video, Inc. v. Alphonso, Inc. n/k/a LG ADS, LG Electronics inc, LG Electronics USA inc The notice of discontinuance only removed LG Electronics USA inc from liability. It is important to note that LG ADS & LG Electronics inc remain parties to the litigation n/k/a means now known as. I have not undertaken a credit reference check on either LG ADS & LG Electronics inc but I would bet that the lawyers have. I suspect they will be good for the damages if any are awarded. Given that the injunction was permitted in part I am pretty hopeful that liability will stick to Alphonso the real issue remains what will be the quantum. The affidavit states there is a significant loss to TRMR but I haven't seen any indication of what significant means but then I havent read the entirety of the court documents. I suspect this will not become evident until discovery takes place.
