it costs millions to do an FDP - - normally its charged to the JV as part of the development costs - if Premier did that then RKH will have trouble claiming they didn't benefit

I don't think, off hand, anyone has ever challenged a DTI/OGA/NSTA technical decision in public. In fact I've never heard of anyone challenging them even in private and winning anything significant. The problem is the time and the costs - it would be ages before it ever made it to court for example.
