I'm not sure about license but I'm pretty sure we've spent 2-3 million in costs. It's good that there is no upper limit on settlement, the jury might decide a larger figure that will actually bruise Tesla rather than a smaller figure which will be pocket change. Last year tesla turned over 95 billion USD ours was 4M AUD 2.6 USD. so if they awarded us 5 million USD it would be like us paying out 4000 dollars, this is pocket change. What's the point in having a patent in the US if a big company can just copy your product and make you drag them through court spending millions then they have to pay the equivalent of a nice meal for the directors. The payout needs to match their income, which is why they were so keen to have a cap on damages.

If the judge decides our patent claims are valid I think Maxwell will settle. They currently are valid as the US patent office granted a patent we have been to court twice with these patents both times in the US and they were valid.

Upon a quick google it seems that this section 35 100 is usually used by the patent office determining the this is not eligible for patent. Given that we got the patent suggests the patent office disagree with Maxwell as it was actually patented.

Trial will always be going ahead as planned unless they settle. They can settle anytime they want.

So if we win this case we will be paid.

We are already financed for the year and with all the new sales pipe lines be in profit very soon maybe this financial year.

With at least 5 million dollars to back us up this is a sure bet IMO.

We might well hit 3p on the settlement date but this will keep rising.

August 2020 we were around 2.8p.

on the 7th august we were awarded 5 million dollars in the Ioxus case.

over the next few month this rose to 13.75p in December 2020. we are now suing Maxwell/Tesla so the award may be bigger and this time it will be paid. The SP may go even higher and will have much more publicity if we win the case.

This time last year we were 4p, things have improved drastically improved since then. so to say we'll be at 3p on settlement of millions of dollars is an undervaluation IMO.
