No it’s probably more likely that since the trial date has changed we need to change the schedule.

OP how are they running rings round us? Their motions are being denied the judge was insistent on the trial going ahead on time until one of their witnesses died, are you suggesting they killed a witness to delay the trial?

I get the impression the judge is holding back on his decision as he knows the 2 parties are in talks and he’d be wasting his time if they settle before court.

It's also worth noting that the judge wants to wait until argument as it sounds to him like the 2 parties are in discussion. he then goes onto say that neither party will be prejudiced by him making his decision closer to the trial date if this actually goes to trial.

My understanding is that the judge knows these are in discussion to settle and this may not even go to trial.

They'll be granted a continuance in certain circumstances. they want more time to replace an expert witness that has passed away. they are asking for 60 days

Hyashi we can only tell Kongats what we think we have no control over his mind. I think we were sitting on the group collectively owning over 10% they can't ignore us, I've bought more since so may have sold but the more people we have in the group the stronger our voice. I think this will be very powerful for us if there is a take over at a shocking price where we all loose but the board gets a pay out.

Yeah I thought it got moved from July to May that’s why I was wondering what was happening in may. This is also the reason Cpx didn’t secure litigation funding. They didn’t need it as the trial was delayed and hopefully won’t need it as revenue will be higher than the same time last year.
