Question is how long has the mediation been going on?
If this is the first session then I don’t think anyone could realistically expect a settlement and a suspension meaningless.
If this is the latest session of a series of meetings then maybe we could be closer to an agreement.’Suspension’ takes on a different context.
A global settlement is not going to be reached in a ‘session’ if indeed that is where this is heading.
But what do any of ‘us’ know….I mean I don’t read books, none of my friends have multiple degrees and I don’t mix with polymaths, authors or well known broadcasters.
Thank God for Nigwit or what ever his user name is today.
: )
“Also most of the legal commentary
is pointless because no-one knows what they’re talking about except a handful of patent lawyers.”
And you now it seems.
Did you read a book on IP litigation between when you posted the above yesterday and today?
Breathtaking over-estimation of yourself.
Samsung had a window of opportunity to buy Nanoco, they passed on that and that window was closed.
They assumed we’d wither away and be unable to fund fighting their theft of our IP.
Wrong.
Now they are going to have to pay for what Tenner describes as jilting us at the altar.
Not long now.
BBD…” We need to think about what would be an acceptable settlement for Samsung too”
My point is that we don’t.We don’t have to think about that at all. Just what is acceptable to us.
Hope this isn’t too bleeding obvious.
If Samsung don't offer what Nanoco perceive to be a fair settlement then the courtroom awaits and a potential award against them the quantum of which is beyond their control.
It's all going to unfold in the next 12 weeks.
Yes the science is complex and I would suggest beyond most of us.
I try not to drill down into it any more.
I tend to remind myself to focus on an overview of events so far.
Our historical collaboration with Samsung after the email from their scientist stating they were stuck.
Samsung ‘jilting us at the altar’ and production magically commencing at a Samsung family members’ toilet paper manufacturing facility.
The entry of Mintz/legal funder. Who on earth is going to go toe to toe with Samsungs’ heavyweight legal team unless they were convinced they had a solid case?
Markman hearing went our way.
PTAB was a resounding victory.
Samsung now attempting to change definitions.
I still think this won’t get to court.
