Onlooker A day after the tribunal verdict, Noor ordered press conference and took congratulations for winning an arbitration, he refused to show up for cross examination, this is on record and is really embarrassing.. They will want to close this saga as soon as possible as chl will release all annulment details on their website. I think icsid will be careful now knowing this fact. It has been over a week and the appeal has still not be registered... :-)

Me personally I think if annulment occurs then Roi will not challenge the forgery again. They are not stupid, if they decide to bring in forgery again the new tribunal will not be happy with them deliberately conning the old tribunal with Putra lies. It'll be over for them, reading the annulment and reading recent successful annulments I can't see why this won't be annulled. I think there is a very good chance of OOC settlement. Imho

Exxon Mobil Corp VS Venezuela case, "tribunal decision failed to apply the proper law in deciding the award", the award was annulled, I have been informed and will not take credit for this, one of our arbitrators (Kauffman Kohler) was part of the initial claim of the above case, the interesting bit is some of chl relevant text in our award appears to be lifted from the Exxon Mobile award. So there is hope!! Even the elite arbitrators can be overruled...

Orbiter OK fair arguments, but what about still continuing to employ the insider and lie to the tribunal. Doesn't that kill roi's narrative?

Onlooker IMHO chl will still have to follow procedure, please bear in mind this can take around 1 year, of course there is no guarantee of winning.

Cossy three major reasons why I think this will get annulled. 1) using inadmissable evidence, which the tribunal themselves struck out. 2) changing the scope of the forgery late on, and failing to allow chl to be heard. 3) tribunal said the legal consequences of exploitation licenses would be discussed later on, chl legal got this confirmed by tribunal but they still ruled on exploitation licenses. These 3 are important reasons for annulment IMHO.

What I have been told by icsid, once annulment application is reviewed the website will be updated within 24 hour. Don't worry guys this application will be accepted by icsid..

Rebel that is an interesting case indeed just recently got annulled, very related to our case indeed. :-) The tribunal in our case failed to apply Indonesia Law to the infection issue (exploitation licenses)...

onlooker Dont worry about funding, i believe the company has someone lined up judging by the results rns. Just my opinion..

Rebel That's an interesting point which many don't realise. We only need one reason out of the 17 to get the award annulled.

Uncanny I contacted Meg Kinnear and let her know the arbiters made a shocking decision with many procedural errors. Its been a week and it still hasn't been registered on icsid website.

Uncanny Agreed A lot of procedural errors occurred in this award and I don't see another award like it. What will go in our favour is that the chl released the appeal papers for the world to see. Icsid will be under pressure..

Onlooker If this gets annulled, we will hold all the cards, but if roi manage to settle before the verdict Roi might get a better deal for themselves. Dont forget the main issue is that our exploitation licenses were taken away due to forestry breaches, roi brought in new allegations to the case, under Indonesian law the exploitation licenses are legal and are standalone licenses. With Roi telling lies of the said "insider" this can go greatly against them when they discuss the exploitation licenses in merit phase.

Dont forget what CHL wrote on the end of the application, "the claimant reserve the right to add to, reformulate or expand upon the grounds above and file further authorities in due course."

Uncanny On what grounds? The fact is even if chl just put down tribunal used inadmissable statements in application that would be enough to trigger the annulment phase. It will go ahead, mark my words...

Onlooker I emailed them. The person who is dealing with the annulment registration is Meg Kinnear, she is secretary general of icsid. She has been aware of this case for awhile, I have been in touch with her previously so have a few others.

onlooker i am curious too, i did contact icsid and they said quote Dear * Once the Secretary-General receives an application for annulment and determines that the application meets the requirements under the Convention and the Arbitration Rules for registration, the annulment will be registered. At that time, the case information will be updated on our website.
