OneJohn Once ad hoc committee selected, DQ expects roi to challenge stay of costs, it will be dealt quickly and then annulment app will be heard. Clifford Chance believes there is a lot of interest in this case, many procedural errors occurred writing this award, worth mentioning tribunal do accept stay of costs and sometimes they ask for a guarantees. I don't think chl will have any problems in not be issued stay of costs. People are putting too much emphasis on this. Worse case we have to use funder but at the end if we win money comes out of rois pocket and not ours.

Gp That's what I believe, provisional stay of cost is put in place when application submitted, IF roi challenge stay of cost they have a hearing this can take couple of months... We won't come out of suspension at least till then.. All imho

Sand grounded Interesting point, chl at the end of the annulment application has said if successful roi should pay our full legal fees. Now there is a case which sets precedence here, chl doesn't have money they can get a funder in exchange for him receiving multiples in returns should they will annulment case. Should this get annulled, it maybe roi paying 9m in cost to our funder...:-)

Lselee If you read the results RNs it imitates that they have spoken to funder, I think they have an gentlemen agreement with them if they are needed.. Case officially registered... :-)

Uncanny, i think you are getting the " stay of cost" confused. Before the tribunal hears the annulment roi might challenge the provisional stay of cost which has been temporarily frozen. If the tribunal accepts the stay of cost stays in place till the completion of annulment then its very good for us. If we win annulment, the award is cancelled and we don't owe nothing to roi.. If roi don't settle the case goes to merit phase and continues...

I must say the annulment app is very compelling, it is very likely that one of the grounds will trigger annulment and they will not look at the rest. Its a political decision, let's see what happens. Imho

The tribunal were caught out by Audley Sheppard when he asked about the " infection issue", they confirmed they didn't want to hear legal consequences for the exploitation license and said they will hear them later on. Yet they still issued a verdict on the license. So they failed to allow chl to be heard, that's one of the grounds for annulment. Question one has to ask why didn't the tribunal use Indonesia law, when addressing the exploitation licenses?

Gp We are not coming out of suspension yet... Its gonna take a month to set the ad hoc committee and then few months to hear arguments for stay of cost.

Onlooker we have a wildcard in that we can argue that roi manipulated and lied to get the conclusion of the award. The tribunal will have to take notice..

Gp I don't think we will relist just yet, the company have updated stock exchange and have asked about whether they should or could relist. At the moment they need to get permanent stay of cost until the conclusion of the award then they can consider to relist.

gp its just a conspiracy theory, it not fact... I just cant understand how world class law professionals can write such an bad award, the obvious one of using inadmissible facts they themselves struck out. Lets see how this pans out...

Orbiter Provisional stay of cost is in place, if roi challenge this which chl expects we will be ready. The ball is rolling now.. A few of those grounds are guaranteed annulment points. Let's see... I still believe the hierarchy at icsid twisted arbiters hand to vote in Indonesia favour.. Imho

Well its official the application has been registered with icsid now, the ball is in rois court, if I was their legal team I will drop out as roi are bunch of liars who are pulling the legal counsels reputation down...

the company believe that annulment application registration can take upto 2 weeks and 2 months, thats the norm, but CC seem to think because so much interest is in this case the registration will be quick.. IMHO If they keep this award on record, this would mean that parties could avoid bringing in prima facie relevant documents which tribunal request and also not bring in important witnesses for cross examiniation but you would be still be able to use the witnesse statements anyway. What a sham award! This will get annulled imho

Uncanny What roi were hoping for was that chl run out of money and give up, that will not happen..
