The court concerned is presently working not by physical presence in the court room itself but by remote access, (Zoom, Microsoft Teams or whatever) and it will have numerous other pre and post pandemic businesses stacked up to get through.
One of Cineplex's last comments on the subject from their stock market updates.
"While a trial date has been set for September 2021, due to uncertainties inherent in litigation, it is not possible for Cineplex to predict the timing or final outcome of the legal proceedings against Cineworld or to determine the amount of damages, if any, that may be awarded.”
you then need to factor in 3 to 4 weeks for any trial, once things get started so you do realise that both Bond and Venom should hit the silver screens prior to any outcome.
All down to the barristers to thrash it out. If we win based on Cineplex breaching debt then we get costs and compensation. If the doctrine of frustration prevails and wins the day then I'd expect both sides to be absolved of their responsibilities under the Arrangement Agreement.
Mooky's last statements on the subject only a few weeks ago is that they expect no liability.
