Project fear is back, I have to say that I hate how unbalanced our media is. They seem to only report negative stories and even then they like to amplify the negativity, it’s not healthy for people’s mental health to be constantly told they are in mortal danger.

HNS yeah cineplex’ case seems full of feelings and cineworld’ seems fact based….that’s a naive statement from senior directors to make, self incriminating in my opinion as a phone admission means nothing hence the cineworld request for clarification / confirmation / proof.

Another thing I like the sound of….but again gotta stay prepared for anything, it’s court. Fingers crossed.

Listening to the collective comments Cineplex are continually admitting to breaching the contract, as they were bound by the covenants to ask for cineworld approval before changing any payment, contract or lease term over $1m if memory serves me right and they didn’t, they even frustrated cineworld when it enquired as to the detailed financial situation of the co. In addition sounds like they as yet have offered no explanation as to why they traded $20m development rights asset for deferred rent payments without cineworld approval.

I like what I’m hearing, but it’s court and there’s always a risk. Fingers crossed simple black and white facts will see us through.

Goodness, 10years is a horrendous prospect as is a judge swap. Fingers crossed our case sneaks through somewhat efficiently.

Yup everything I could afford to lose, forecast a mid 2022 exit when I made the investment, so no immediate panic but obviously didn’t see what we have all seen happen over the last few months coming.

I was most intrigued by the body language of the judge and the cineplex lawyer once our guy got into his stride.

The judge looked kind of frustrated, perhaps with our guys Mike technique or perhaps the fact that he had just proved numerous contractual breaches and knew she was going to potentially have to sit there for 3 weeks waiting for the opportunity to throw out cineplex’ case.

Cineplex lawyer looked either bored to tears or like he had ants in his pants and was being forced to sit there and listen whilst his case was harpooned on day 1.

My take on it was that our guy brought simple black and white evidence that cineplex were in breach multiple times dating back to before the pandemic….these simple facts I hope will sooner or later win the day.
