Calamari I don’t see anyone claiming there was an investigation, posters are saying the fca had a close look at the company and either decided there was nothing untoward and no investigation required. At worst they opened an investigation which was extremely short lived and gave them enough assurance to restore the company to trading! If there were outstanding concerns then the suspension would still be in place.

What do your mean ‘stealth restoration’? As soon as FCA happy they would restore trading immediately, that’s all there is to it.

Re new clinical director coming from AZ, wasn’t the transfer of staff from a potential buyer to the target listed as one of the indicators of a potential acquisition?

@Pipster the FCA would not keep suspension in place for this reason. They would do so if the company were actually insolvent and administrators being appointed but this would be announced if it were the case. Running low on working capital and facing the possibility of a placing or sourcing funds from elsewhere would not be a reason for suspension, quite the opposite, it would be seen as fixing a price, which the FCA will not do.

Kammi - I wouldn’t hold your breath to find out any details of what conversations are taking place between SYME and FCA because unless it all ends in a public censure it’s very likely we will never know. Once restoration happens however, you should relax in the knowledge that FCA is satisfied.

I’m not sure in this case I’d agree about transparency, taking the example from my second link, there could be an individual at the ‘end of the line’ of investigations the fca is undertaking, who may be acting independently of SYME itself, so what may appear innocuous to AZ could have the result of tipping off someone actually in the FCA’s line of sight for some reason.

I can’t say for sure that it’s strictly a legal requirement but FCA ‘have an expectation’ (rule 4.6.1) that anyone subject to information gathering queries/investigation would not disclose anything publicly or to 3rd parties (exception is if their professional advisers are required to be involved).

In a situation with FCA approved firms under scrutiny, the FCA have issued reminders that all communication should be kept confidential so as not to compromise any investigation, however inadvertently, which may ultimately also affect a criminal case. Not the same situation for SYME (not an approved firm) but it’s pretty clear the FCA would take a dim view of any disclosures about whatever is under discussion.

Airlineboy my 12yo daughter had long covid last year, during the course of which she had a covid test at hospital. She has also been very upset at having to repeat it but the tests for schools instruct 2cm inside nostril, not the ‘old’ method of seemingly right up into brain! Still not fun but much less unpleasant - HTH

This was suspected quite a while ago B2, when Manaus, which was so hard hit first time around that it was believed that herd immunity would have been achieved, then got hit even harder by second wave towards the end of last year, the obvious explanation was that immunity from 1st infection was not helping fight the new variant.
