Roger - No I haven't conveniently forgotten about Avion. If a big pharma buys IMM, big pharma then gets to deal with Avion (just as IMM currently do) UNLESS there is a clause in the original contract that prevents a working relationship between Avion and big pharma.
While working in the opposite way, IMM under the terms of the original contract with Cephalon, recalled the rights for Lupozor due to the Teva merger as Teva had a lupus product in their portfolio. Before anyone screams 'It's not the same thing' - agreed, however it demonstrates that licensing agreements often have clauses to handle corporate activities such as takeovers, etc.
