Of course bidstack feel they have case hence why they have sued.
I’m just saying it is ultimately irrelevant and has no bearing on the outcome.
Bidstack will make their claim as plaintiff, azerion will defend, and the contract will be scrutinised to see who wins.
Let’s say this swings in azerions favour, they could then counter sue for breach of contracts and seek damages.
They’ll be a costs to counter sue so Why counter sue now if azerion are prepared to go court (assumption), as the courts decision will determine whether there was a breach.

If there is no out of court settlement, we should be more concerned here as azerion will also think they have a strong case

Bidstack are suing for non payment.
Azerion not paying as stating breach of contract.
It’s irrelevant that bidstack are suing. They have no choice but to if they want to try and get paid for services.
At the end of the day The issue boils down to whether bidstack adhered to terms of the agreement and this will be decided in court.
Why would azerion need to sue? They don’t!
