Interesting thoughts but the term "may be illegal" also means it might not too. I suppose if they were to be charged it could end up in court, then to be decided or more likely there will be lots of law fees whilst the arguments go on.
Even if it is legal, is it morally correct? I suppose that question can be asked of all companies. With dividends, high pay, bonuses and share schemes there are various ways to do wrong or harm to shareholders interests.
I know lots of companies pay out dividends not covered by fcf. Vod and GSK come to mind. I suppose they had plans to turn around their businesses and for the metrics to improve with time, as is the case here. Of course if the plan fails things cant go on indefinably. Think Tesco!
That was a question at the results presentation. I got the feeling that they wanted to keep the final divi to reward shareholders but that it would need the plan to work and so prove to be a temporary bad trading period. They also seemed to hint that early indications appeared promising and that several factors that had worked against them should reverse and that H2 should be stronger than H1.
A divi cut could be positive for the SP as its not paying out £150m every year. As for divis having to be paid back, might be ok with institutions and large holders but I suspect Joe Public might be more difficult, Ive spent it down the pub and a curry me lord!
Any examples of divis being made to be paid back?
