Logic would definitely suggest that, but it’s been that way for months now and they’ve just messed around and not been serious. AC stopped talking to them because they were making ridiculously low, derisory offers and insulting him and the company into the bargain.

Fair enough, and time to move on and look forward, and accept that in principle AC hasn’t played it straight with us but in practice it’s not an issue.

See that Oslo has hardly reacted this morning.

I have to say that I think AC’s comms could and should have been a lot better over this. It was obviously going to cause a lot of concern, and to issue an RNS after the market closed on a bank holiday weekend is not clever and slightly naive.

He needs to take advice from comms professionals so that his loyal shareholders are kept informed and remain advocates.

I think you can forget logic and efficiency when you are dealing with India. They love process and will happily duplicate and triplicate process and see nothing wrong with that. I say that as someone who was a NED on the board of a quoted Indian company for several years.

It was process heavy, and painfully slow, culturally.

I certainly understand your frustration.

All I can say is that it really does look as though the end is in sight now, with a positive result on ICC1 and a special divuro be paid before the end of this year; a positive result on ICC2 but to be confirmed formally by the summer, then, I believe, a positive result in prospect for the massive ICSID case, result due next year.

Whether you want to cash in on these cases’ results, or stay in for the longer term and take special dividends along the way, I honestly believe you will be well off either way.

I really do think your perseverance over those 7 years will be rewarded but frustrating in the short term, for sure.

Another acquisition on borrowed money which won’t pay back for years.

We need to see a special dividend for ICC1 paid out to shareholders before more spending on the distant future of the company.

For anyone who doesn’t want to read all of Swen’s report but wants the critical references to ZEN, here they are. ZEN is compelling!

“What makes this case special is the fact that Zenith Energy has filed three separate claims, with the first one already awarded USD 9.7m in damages.

Even though this was the smallest claim, it had a game-changing effect. For the other two claims, the matter is now no longer whether the government of Tunisia acted unlawfully, but how much damages are awarded to the company.

The other two claims are for USD 130m and USD 503m, respectively. The decision for these two cases is now expected for mid-2025 and early 2026, respectively.

Tunisia is unlikely to make it easy for Zenith Energy, because countries never make it easy for winning claimants. However, this is a country that has the means to pay, and which owns assets that are vulnerable to being seized by creditors abroad.”
