Regardless of what ER has given as the official justifications for his refusal to grant the LU, this case will become about him and his agenda.
The rhetoric from both BEY and LOGP is making it clear that this situation centres around the actions of 'The Minister'.
If ER gives an indication that the unacceptable and uneccessary delays and ultimate refusal is associated with a shift away from fossil fuels to renewables, then LOGP totally have him in a corner on ECT.
If he takes the stance( as indicated thus far) that the decision was based on the financial capability of BEY/LOGP then it will still become about him because he used his discretion and applied subjective guidelines to make the assessment.
I cant see how he can argue that his discretion was fair and equitable towards an oil and gas development, considering his party affiliations, especially as the ability to draw down funding for the next phase of the development was in place. IMO he is scuppered and he knows it.
He either succeeds in blocking it but at huge expense to taxpayers in compensation or his political associates agree to hang him out to dry and overturn the decision.
I cannot foresee his preferred situation where he manages to block the development without a huge compensation being paid.
