Stanc, cripes is one who posted on Tuesday, sold on Friday funds still in his account. There may be more who have not posted. It does seem Brokers are not standing together!! It would be interesting to hear the experience of those who Purchased on the Friday before Liquidation??

Vijay......as previously stated, please read the Market Rules as it seems likely the Broker is not observing, whether the stock is suspended/liquidated or not. It is a lengthy document but will help.

Stanc, it does not stack up to me. Maybe others here have a view, but why your Broker is saying Carillion have not payed is quite bewildering. You entered into a Sale Agreement ( Contract) before suspension and Liquidation, funds resulting from that sale were transferred to your account which enabled you to Trade another Stock. The Carillion Sale Funds were then withdrawn from your account. The Stock Exchange rules appear to give you a level of protection in that the Broker has not acted within those Rules. If this matter were to proceed to Civil Action, and I am not suggesting you take such action at this point, on the face of the evidence you state, a Judge would take a very dim view of the Broker's action. I suspect you are probably a relatively small investor and the Broker is trying to wear you out expecting you to forget given time.

You guys need to read the Stock Exchange Rules ( Fleccy gave a link on his post 3 days ago). You may wish to consider a Complaint to the Executive Board of the London Stock Exhange. It looks too me as though the Broker is pulling the Wool over your eyes. Carillion did not buy your shares, the Broker is using the Liquidation as a smoke screen, which is a disgrace when reputable Brokers have settled without fuss.

Maybe some Brokers have been caught short....that is their problem. It is strange Brokers are able to withdraw funds from a Sellers account but NOT the Buyer's. Do they ( Brokers) operate different rules for some? How the hell can a Broker make the Buyer's shortcomings your problem? Hope you are taking the appropriate action!

Judge........without positive news, JOG will do their credibility NO good whatsoever! Don't forget the presentation is in front of Influencial Lenders. Don't be so pessimistic.

JOG present at the OIl Barrel Conference next week, it will be surprising if there is not an update as the Audience ( Institutional Investors Etc) will ask questions.

QA12 ok send a letter( recorded delivery) setting out events, and critically the Contract was arranged before Suspension. remind them the Funds were payed into your account and then withdrawn (did they give you formal notice before this event?) I suspect not.Just advise other Brokers have followed Market Rules and have settled trades in Carillion without fuss. Ask them to confirm by return when the funds will be restored to your account. Try to find the name of a Senior Manager to address your letter too. Try looking on their website. Do it today.

kenji we agree getting a swift resolution is paramount.Keeping it within House and importantly to a rigid but fair timetable is critical. We have only heard about QA12 and Stanc's experience, there must be other Equinitti Clients similarly treated....hope they are reading these posts, because as you say they need to review their use of Broker . Hope the Broker is reading too as it is not good for Business to see such publicity.

kenji having had experience with the Ombudsman service, they tend to go through a very mechanical system, dotting all the "I's" etc. They will want to know exactly what action an individual has taken to resolve. In my case against an Insurance Company where the evidence was clear-cut, the process dragged on for 18months. The first obstacle being " due to overwhelming case-load a delay in allocating an Officer must be expected". The Ombudsman service is Funded by the Industry and usually toothless. Understood QA12 and Stanc had recd emails and not until today has QA called Equinitti. A Diplomatic solution is far better than having to embrace another time consuming process. All that said it is a Client's decision which way to go.

kenj whilst the substance of your advice is sound, the complainants want a swift conclusion and not as we agree a lengthy process which can be very wearing. Even though phone calls may be regarded as futile, they are recorded and can be used. A Diplomatic approach may well provide a quick result, but if not and as stated earlier a Client should not delay beyond a day or 2 in taking the action stated.

Bamps a well attended AGM which is good, no doubt the Hospitaiity helped! The inclusion of another 1500 Houses could be a concern primarily from Location and Customer Patronage. Is it reasonable to assume Management have weighed up all factors with the integration of these Pubs? Were any questions raised in this respect?

Stanc, QA12, Equinitti's actions are quite appaling when judged against the way other Brokers have settled in similar situations. They (Equinitti) have created a situation which enabled you to buy another stock on the Basis of Funds realised from the Carillion sale. Have you tried phoning? Put them on the spot, the stock was NOT Suspended when you Sold so that excuse is a complet Red Herring. Let the Broker know other PI's who sold during the 12th have had their Trade Settled without problem. In other words DON'T take No for an answer. If necessary ask to speak to a Senior Manager and let him know there are a number of Equinitti Customers who not happy as the Broker is not abiding by Market Rules. You both and anyone else involved will need to take the gloves off with the Broker if a Diplomatic approach fails. Whatever else keep an accurate diary of events.

CloudyMountain is the Market regulator able to become involved which would save the hassle of Litigation? From posts so far it seems just one Broker is playing "hard-ball". Members would do well to note!!
