I think the Gov and hence DHSC standard policy is to just not pay.
It seems clear they use the same tactic with everyone, look at what they did with Omega Diagnostics (now CNSL) and Abingdon Health, to name just a couple in the diagnostics sector (actually a large proportion of diagnostics suppliers at the time).
Look at the PO scandal, the infected blood scandal, the mortgage prisoners scandal...all the same behaviour by Gov to just drag it out for as long as possible (probably so somebody else gets the blame, but also due to funding shortages). NHS is absolutely on it's knees as well due to lack of funding. Everything in this country is....!!
The complaint was supposed to be about testing accuracy as far as I can remember, no test is ever 100% accurate, whatever the test, but to then buy off the Chinese with tests that were banned in the USA and classed as dangerous (40% accuracy) is ridiculous. It was obviously about funding and that Boris/Matt H wanted the COVID numbers to look lower than they actually were (probably a crafty way to avoid longer lockdowns)
I'm fairly confident it will go well for Novacyt and the DHSC has to pay additional compensation for their underhand tactics causing 2 yrs plus of stagnation within the company.
The DHSC is still dragging out the Omega lawsuit, which even stated they didnt need to pay back the £2.5M if no test was ordered, they are in a similar position but ended up selling 2/3 of the business and probably making some redundant.
I think the DHSC is basically incompetent and that will be easily shown during the court case in June.
