Also, our counter claim states that Cineplex breached this particular condition:
"Under the terms of the deal, the sale would not proceed if Cineplex breached a level of C$725m ($535m) debt. On Friday, Cineplex said that it had C$664m of debt outstanding at the end of June."
It could turn out that the courts do actually see Covid as reasonable grounds to pull out AND that Cineplex breached the agreement with the debt.
So I'd say it's close but ever so slightly in our favour.
I can't find it anywhere now but remember reading at the time that Candian courts do not recognise Force Majeure in this instance.
We could end up liable. But in that event, I can't see it being anywhere near the full buyout amount Cineplex are claiming and even then will not be all payable at once.
Still. Something we could do without and has been a monkey on our back for quite some time.
One way or another, we'll all be glad to see this resolved so we can move on.

Funny to hear Mooky and co talk about the pleasantly surprising uptick in concessions.
I wanted to dial in and tell him it was all down to me buying up the hotdogs and ice creams.
I'm on a diet now so apologies for concessions returning to normal on the next results day.
Although I had a large Nachos and a blue slushy thing tonight watching Stillwater which is lite eating for me.
Really sweet film by the way and loads more watching than I expected.
Covid is over.
The U.S and global media will be all about going back to Afghanistan soon enough as well as ramping up the hysteria on climate.
That'll keep the social media zombies clicking away at media rage bait for another good 12 months at least.
As soon as Covid drops off the media, people will forget about it.
And Top Gun will absolutely smash post-pandemic records.

I'm in this for years.
The results will show that we have been running at a loss barring a miracle.
Fully expecting us to get hammered into the 50's as a result or even more if they indicate the Cineplex issue isn't going well.
But with Covid fading away, I do expect Mooky to come out with some strong forward looking projections that will hopefully be crystallised in Feb/March's results from where we can really start to motor back to full health.
Hope I'm completely wrong though and he has some surprises up his sleeve, tells us the Cineplex case is sorted in our favour and all that knocks the shorter's ducks off and sends us back up to a quid at least.
TL/DR; Fully expecting a nasty drop on the sp tomorrow but don't lose heart, we should come good soon enough.
Covid news will be chip paper in the next month or so.
Media have milked that teat dry now and realise that the public are fatigued with it.
They're now starting to ramp up climate hysteria which will keep them going well into next year at least.
Can't see a way they can link that to cinema attendance so with Covid deaths and cases dwindling away, we've hopefully seen the back of that chapter.
Just need to get rid of the Cineplex monkey off our backs and we can proper crack on.

Will make for an interesting watch tonight.
Given how easily this was walked down to the 60's from £1+, my personal hunch is that they'll use the results as an excuse to get us down to the 50's or even 40's.
BUT with the Delta variant expected to peak in the U.S mid-August and follow our pattern to drop into September, that would be perfect timing to restore consumer confidence stateside for the big hitter movies lined up for Autumn and Winter.
Having been in this share for ages now, I expect histrionics and handbags on results day followed a month or so later by some trademark Cine bounceability into a higher sp range that will have everyone chilled and discussing biscuits again.
But I've been pretty wrong on most things so hopefully I'm eating another hat on results day and this rockets up.
Food is a great analogy.
Restaurants will survive despite cheap supermarket food cos it's not the same.
People will pile into football stadiums next weekend instead of watching on Sky because it's not as good watching on TV.
McDonalds will survive because despite all the options, their product and service is the best - just like going to the cinema.
Peope will continue to go to the cinema because watching on TV is not the same. It's a poor substitute - even if you are lucky enough to live in a detached house so you can't annoy the neighbours with the surround sound and still inferior 75 inch TV.
But most people in the world live in flats, appartments, semi detached or terraced housing and can't afford to get that (still) poorer experience.
And you've answered your own question in your last sentence.
If people are getting it for free, the studios will pull it from streaming. Simple as.
THIS is why streaming will never take off..
