The deal resulting out of the disagreement between FRR and YA suggests three things to me; a) that the deal clearly favoured FRR, b) this meant that YA must surely have been found at fault, otherwise why else would YA agree to terms that favoured FRR, this especially after YA tried call a default (we know though they naked short sold FRR shares they were entitled to), and c) that if YA had been at fault, like and others believe, why were they let off the hook?! I say this as the resulting deal was only a restructure, even in our favour. We could have gone for the jugular. Some folks maybe aware that the SEC have been after YA for a while.
So what gives?!
I can only conclude that YA may be supporting our case against Hope and OMF with critical evidence.
