atan - i am obviously going for number 3. i suspect the gov wanted the full amount back (as the contract is on their side) and odx were going on about compensation - in hope of a negotiated amount. could have back fired?

i still think the gov will want to be "seen" pursuing wasted money to do with covid. unfortunately they can put pressure on the uk companies that they can't with chinese and turkish etc. so not convinced that the gov will settle for less than the full amount.

if odx get away with paying half then that will be a result

jc0 - both parties will want to be seen as having been open to mediation - if it goes to court. it shows willingness to be reasonable..whether it is true or not

i agree that the gov has been dragging their heels..it is the buracracy
however odx prob were happy for to drag on when they didn't have any cash.

even now i suspect they would prefer to drag it out than pay. and they have done the right thing by trying to "bluff" the gov that they should be owed compensation. they have had the cash already so it is up to the gov to get it back

my suspicion is that if agreement has not been made ..the gov will soon file a claim. However then you will be looking another 18 months plus for a court date

mediation it isn't a court case - there was either appetite for it or not

I don't think it will drag on - most civil mediations conclude in a day...if there cannot be an agreement then it will go to court

so we now know that my option b was correct.
