Totally agree Mountainous, although I suppose Mr Mark has provided us with some excellent comedy :-)

His synergies argument is just a non starter, I can't understand why it's even allowed to be argued in court. Even if the deal had gone through the synergies would have been gained by Cineworld not Cineplex so with the deal not going through how can they demand lost synergies in dollars they wouldn't have got anyway. I think Enzo explained that quite clearly, and synergies are not just a financial gain in a takeover.

I dont think Barbara was too impressed with him yesterday either over the part where damages would be given to Cineplex shareholders. Remember when Mr Mark was angry with Enzo for pointing out that many CP shareholders sold after June 12 and it would be new shareholders that would benefit from the claim

Yes it should never have gone to court, asking for $2.1 billion for nothing in return annoys me too, just by the fact Mr Mark has the nerve to stand there like a lemon as if they are being reasonable!

I agree Mr Steep was excellent. What did you think of when Barbara was in disagreement and seemed frustrated with Mr D'Souza? She was even siding with Mr Mark. I thought he pulled it back well, but she did ask the question why did CW not have any concerns with the rent not being paid in April but they did in June and he had no option but to point to their state of mind before the without prejudice talks which seemed to anger her. They quite obviously were aware during those talks but as he's not allowed to discuss its content he can only point to their thinking prior to it to answer her question

Mr Mark is asking we pay Cineplex shareholders $34 a share in damages!? Barbara has a few questions on that! Totally unreasonable

If we lose Bonkers I think it will depend on what the judge awards CinePlex. If she decides they deserve the ridiculously unreasonable $2.1 billion they are demanding then we are probably stuffed as we would have to borrow it and who is going to lend that money when something isn't even being purchased anymore? If she decides we have to pay a few tens of millions in damages and legal fees then I think we will be OK and the SP will drop a little, like with the Picturehouse Central landlord case we lost

I'm guessing she will decide its a 0-0 draw though which counts as a win for us due to the silly amount CinePlex want, all we lose is the legal fees. From watching yesterday though I was picking up that she is getting a little fed up with the rudeness of Mr Mark and Miss Rosenthal and she is perhaps thinking their demands are unreasonable too

Cineworld closing written submissions
Cineplex Reply written closing submissions

..indicating that in Oral submissions Cineplex will get a reply too?
