Sounds reasonable Bakky but you cannot ignore the case as you show in deducting costs from your valuation! We are practically worthless and at the mercy of TF. We cannot survive without the generosity of TF because we do not have enough money to pay IL’s legal costs and any damages. I think I am in one of the stages of grief, not sure which but it’s not anger it’s becoming acceptance! We have played this badly, gambled and lost.
I just cannot see any reason for Illumina to settle or come to any compromise with us from this position of incredible strength, other than to avoid us being bought out by TF. And would they care about that given their latest victory and their size?
putting the case to one side, what is the value of Prem. Would it 10 x revenue plus a premium as a growth company in a growing sector. Then subtract debts and Illumina costs...anyone?
I think our only option is a sale to TF but I am under no illusion they will do this on favorable terms. They have their own interests to look after. They will have to pay to buy us out and take on our legal and other liabilities. I can’t see Illumina doing anything else other than keeping their foot on our throat and slowly but surely suffocating us. What incentive is there for them when in all likelihood we will perish or be bought out by TF? We need to raise funds and quickly and I think the only way to guarantee the survival of the company is to sell to TF. I hope they do it quickly or this will be death by a thousand cuts.

How difficult would it be to changeable the sequencers,and be backed by Illumina? Could this be an option if they said they would drop all damages if we were to change? What hold do TMO have over us except for a loan? Okay they have backed us, but we now have our backs to the wall, so to speak.
it was definitely worth getting out when I said at 5.25p yesterday, it's still worth getting out at 4p today.
Yes dark days. Especially given all the private and public reassurances by the BoD and third parties. We just have to think logically what's the likely scenarios from where we are. Despite any bluster and public statements of appeals the company will try and avoid that as it would distract them and dilute completely. So likely scenarios are ultimately settle or distressed sell or a combination of the both. Obviously Illumina will bluster and play hard ball but then a distressed sell would come sooner than later and for more than 4p.
Hemo, it will all get sorted out now one way or the other I reckon, I can't see the other claim happening. I just hope they do not go ahead with a feckin appeal, however, it will kick the can down the road for ages and give them more time to concentrate globally, not sure I want that though!
Let’s also not forget we have a fourth patent claim to defend. I am losing the faith slowly but surely.

what concerns me is that Illumina might not want to play ball on any sort of negotiation, they just want maximum total costs and Prem to clear out of Europe.We might need the judge's/ EU help for any licences etc!
The verdict has provided a new reality which everyone is adjusting their stances. Ultimately TMO need their warrants to be exercisable or risk losing 15m dollars. share dilution for an appeal or damages that don't need to happen doesn't help that. Neither does making Premaitha a non going concern or further distracted. Their focus is on the strategic value outside UK
nice thought that TMO will agree to let them switch platforms in covered territories, makes sense but just can't see it happening.

Exactly. There will be an intense session now when Premaitha will be trying to secure various commercial options. For example license opportunities to Illumina if it switches platform just in the affected areas which TMO would agree to keep Premaitha a going concern and a growing incumbent in Asia which is the strategic concern. Otherwise options for a distressed sell. Premaitha will only have a few weeks to do this before next hearing but the market will demand this done sooner. Till then there's no point working ourselves up
Hi, you mentioned that the judge is not happy for us to do the sequencing in the uk, does this mean the large laboratory we opened, will now be of no use?

yes they are after everything, but that doesn't mean they will necessarily get everything - at the end of the day its down to a judge to decide and that's the beauty of it - we all all speculate but it doesn't matter what we all think .. if you think it will come good then buy - otherwise sell...
'damages, injunctive relief, and attorney fees', .... is what they are after...! Take your pick on how much for attorney fees and damages? .
sorry the last point should be - Is the business good enough to survive without the UK Market Could also add - Will TMO continue to back the business?
Effectively comes down to a few key points - for which we all have no idea yet until further info comes to light -What is the max that Illumina can claim - this will be limited - How can Premaitha circumvent the patent - move the processing offshore - Is the business good enough to survive with the UK Market? If you believe the above will come good then buy, otherwise sell.
I see that they will apply for 'injunctive relief' so confirms imo they are looking to stop Prem selling a bean in the territory it seems! Just got to hope the judge doesn't side with everything they want.
Presumably their costs will be split between the defendants? - they won't be able to claim the same costs three times! I expect the judge will work with both legal teams to find some kind of compromise... If we aren't a going concern, Illumina won't get their money anyway ...
not sure about the punitive damages, hopefully the judge won't want to punish Prem any more than they already have, so unlikely imo.
