How did the govt barristers call it right ?
Be under no illusion , the govt wanted the case stopped . The application was to basically say NCYT couldn't win , they put forward their strongest arguement and the judge dismissed it. In other words Novacyt have indeed sufficient evidence to win this and you will not shut it down. It was a chance they took and the govt lost.
Let us not forget that Ncyt had to undertake training of NHS staff , requested by the NHS.
I believe around fifty such sessions were held. Odd that if it wasn't rolled out anywhere.

Gaz..imho it was either a bluff ( game of chicken as I said before) or as you say a test to see the waters.
I would have thought there could have been a chance of a settlement on the dismissal...but unfortunately I don't think the coverage in press yesterday was helpful for that.
A settlement now looks like too much of a backdown for the gov.
Taking small UK companies to court is a pr exercise in the gov trying to look robust with tax payers money ..even though everyone knows they spaffed gazillions on sub standard foreign xxxx.
I mean how accurate were the lft that they used when there were much better UK alternatives? Sensitivity and specificity weren't so important then
The takeaways yesterday
1) the judge seems fair and common sense - which is my experience of commercial court
2) the gov barristers called it right
There is still a huge risk...not for widows and orphans..but I feel we still have a strong case. I can't see how a product that obtained CDTA approval...and we know how difficult that was ...can be as bad as the gov tried to say yesterday. Doesn't make sense

We're at potential settlement stage now and we know full well the only way a settlement happens is if it's heavily in NCYT's favour - so there's some logic to holding now for that with traders possibly exiting in early June if it does indeed go to trial.
When the spread is large..i always take it that the mms want to curb buying.
If as soon as buy you are going to be huge amount down then that will put people off - eg if you need 10% to just break even again that is quite a bit

There will be the usual early morning rush to take a quick profit from short term investors. I have no problem with that, I’ve been there and done it myself. After all we are all in it to make a profit. Once stabilised, I think we should start to see a good steady rise.
Is interesting are the MM's trying to make most trades look like sells or ar they trying to make most trades look like buys ?
That said the difference seems clear in ypthe trade prices.

I think you have a point there, People love saying the Tory Government is corrupt/inept but those of us you know even a little at local government level know how much Civil servants have processes and can be the main decision makers
They will drop the case for sure now.
I feel quite pleased with myself for adamantly and consistently calling the share price to reach 80p in the run up to the dispute, even with the SP at 43p one month ago and with all the negative folk on here calling for 30p.
I hope it isn't just Amers that made the most and loaded up whilst it sat at the bottom for months !

It means DHSC officials want to ensure that the Tory Government suffers s humiliating defeat just before the general election.
I think the fact that we are up 80% in one month shows what the market thinks of this share now and its future. Very positive.
In terms of the outcome of the dispute it doesn't mean much although we now have further sight of DHSC's position which appears to be weak. DHSC will know NCYT won't be intimated and will go all the way. Its very strange that they made the app to begin with when there was next to nil chance of success. My best guess is it was a fishing expedition to see if they could glean any info from Nova or the judge or something to do with internal politics e.g. whoever is signing off the case said you need to have a test then case before settlement
Answer will be in the price.

Novacyt wasn't asking for Summary Judgement. The DHSC were. and they have been refused .Surely a deal is likely -though shudder to think what the legal costs will be!
Imo this means that there is merit to arguments on both sides which needs to be examined in detail, hence proceeding to trial
