So following on from Zen's post earlier that the injunction was in place in the caymans until the end of April, I think what has happened is the following:
1 - Frr sought an oocs. Hope wouldn't budge.
2 - in order to apply more pressure, Frr had to choose between the caymans and California. Both needed an injunction/TRO, but the threat of the jury trial seemed a good means to apply more pressure on hope to accept an oocs.
3 - hope is presently contesting the TRO, understandably from his point of view, but I agree with others (Symore etc) that he would do this, wouldn't he!
4 - I think the TRO will be granted and when it is, the oocs settlement discussions will then resume.
So no need to panic just yet....GLA

Sure enough, a new doc has just been listed "Opposition/Response to Motion". I assume this is Hope's teams response.

My assumption is that the new doc “Order on Motion for Pro Hac Vice” is the granting of Hope’s lawyers right to appear in the Californian court. So we should assume that they have filed their defence against the TRO today and that this will be heard. But until Danie1son confirms the above, we won’t know.

Yes Timster - you are right. This is an application by FRR to have a TRO put in place after Hope refused to agree to "informally" agree not to go after all of FRR's assets. We now have to wait and see whether the court agrees that a TRO is necessary.

So following on from MP's post, is this the real reason for the court case in California? The Caymann's case led to red flags against Hope/ Outrider. They couldn't clear the red flags in the US without going through the motions in California. So Frr made their case, Hope rebuts it, they then tell the judge they are working on an OoCS. He then decides that there is no need for the TRO as it will all be sorted amicably asap. This way Hope's official reputation remains clean and everyone gets a settlement with which they are happy (hopefully including us!)

Sorry but I cannot believe that’s it. They will have been told to sort this out. Oopsi suggested earlier that a oocs would have been worked on already and just because they haven’t managed it so far, doesn’t mean they won’t manage to do so in the end. People’s emotions have been from devastation yesterday, to elation this morning, to devastation again this evening. We will eventually find out what’s been going on, but at the moment it is all guess work. As hard as it is, we just have to be patient. GLA

So a positive spin on the day’s events might look like this:
1-We offered to settle in cash (OoCS).
2-Based on Madpunter’s post, Hope refused (as his naked shorts would still bankrupt him in an FRR re-rate scenario).
3-Hope decided to attempt to seize the assets via the US courts, knowing that Kawaley would rule in FRR’s favour.
4-FRR got wind of the US action and preemptively went to California to initiate proceedings (garytrader suggested 3&4 in his post).
5-Late to the party, Hope still fires everything at FRR via the US courts in a last ditch attempt not to lose everything.
6-All to play for, but Zaza very much in the driving seat.

PS - what is the restraining order about investmentboy? By whom ; against whom? Have they been scrapping outside the court again?

Cast your mind back a few days when we found out which lawyers were on our side in California. At that point several posters made the point that they wouldn’t get involved if they were likely to lose: reputation is everything afterall. And then we heard that we’re still spending money on lobbyists and posters mused that we wouldn’t be doing so if we had already lost. Today’s papers suggest that there is still a long way to go, and clearly we’d all prefer to hear some good news, but overall this simply means that all is still to play for. GLA

Bezzy - thanks for spotting the dates. I agree with others that too many posters are very quick to assume the worst. In reality, Hope has responded to our California petition with his own counter claims. No surprise. All this does show is that we are a long way from an OoCS. It may still happen, but they seem to both be squaring up for a fight, seeing who will blink first. If neither gives ground, we will end up in court again. The big question is what occurred in the Caymans court to precipitate the move to California. And have we completely finished in the Caymans now, or is there still more to take place.
And there was me thinking it was going to be quiet until someone uploads the Caymans Court documents for us all to read, hopefully tomorrow night. GLA

Coggy, not coagulation!

Coagulation. Regarding the possibility of a buy out for FRR Georgia, I’d presumed that the company would be offered X million/billion pounds. They would then apportion a percentage of that to shareholders as a dividend, giving them y pence per share, leaving the reminder as working capital for FRR to progress on its other activities.

One for the shorters to ponder, not delisters! The shorters will definitely rue the day that they got into bed with Hope, when and if FRR finally return to the market (hopefully the FTSE).
