Legally we are not in "the equation" apart from being beneficiaries of milestone payments, as the Licensing agreement was between CRT and Sierra only.
As I see it IF GSK are to run with 737 then there has to be Novation of the Licensing Agreement i.e. GSK, with the agreement of both Sierra and CRT, agree to take Sierra's place and so agree to take on the Licensing commitments. If they refuse, however unlikely it MAY seem, then what next??? Could they run with 737 and tell CRT to get lost?? Again seems unlikely but when TM issues an RNS emphasising that GSK took over Sierra primarily because of them wanting to get their mits on Momelotinib with 737 getting a sideline mention only, one begins to wonder, what next??
Overall it might be that the takeover document includes all Sierra's commitments to third parties. Without seeing it mostly guesswork but hopefully 737 will be and so speed up its rather rocky progress to date.
