The royalty terms are set out in the document confirming the sale of the royalty to Evolve Royalties Ltd.
Royalty rate structure (production-linked). Current / low production (≈1,000–1,600 tpa) 9.63% → 5.13% (sliding scale). Interpolated as (if) production increases within this band.
Stage 1 expansion (1,600–2,000 tpa) 4.50% → 3.61% (sliding scale)
Post Phase 1 (2,000 tpa up to 9,800 tpa). Flat 3.61% royalty.
Large-scale expansion (>9,800 tpa). Drops sharply to 0.86%
Once a total of 95,500 tonnes of tin has been produced, royalty reduces further:
–75% on the first 9,800 tpa
–87.5% on production above 9,800 tpa
At current output (~1,000–1,100 tpa), the royalty sits near the top end (~9–10%) . How AV could have signed up to something where failure to hit targets would incur a punitive royalty is beyond me. Given the amount Evolve paid to acquire Orion's royalty you can't help but feel that they don't think things will be changing anytime soon.
