You need to read the context in which Bell was speaking. Unfortunately, our media (including the Times) has a habit of decontextualising statements in order to generate a headline.

And the Grauniad is no better than the rest of them. It hasn't been a reliable paper since Rusbridger ruined it...

That's not how framework agreements tend to work. Most public sector frameworks (e.g. the NHS Increasing Capacity Framework: https://www.ardengemcsu.nhs.uk/nhs-england-increasing-capacity-framework/ ) have the capacity for new entrant windows.

Call-off contracts are different. They're awarded to a single provider (often via a framework agreement) but they will often have no minimum order requirement (i.e. they don't have to be called off/utilised and therefore payment of the quoted ECV is not guaranteed).

The 2021 Rugby League season doesn't start until 11 March so it's perfectly feasible that they'll use the Mologic/Visitect test.

We cannot sell to any third party without the Government’s permission.

The option for the extension to the MHRA deadline was only exercisable by the Government - not the UK-RTC - and if they chose to extend, then the consortium won’t be able to refuse (similar to the Schedule 3 extension provisions in NHS contracts).

The first refusal/DHSC permission provision would have applied until 14February anyway, as that is when the current agreement with HMG expires. I would not be surprised to see a fresh agreement between HMG and the UK-RTC announced in the coming weeks (subject to the current judicial review proceedings).

Fairly standard wording for this sort of tender. The bit about lots is boilerplate text - the preceding bit indicates that the tender is for a single lot.

The real ‘fun’ ones are when they issue multi-lot tenders but don’t describe the lots correctly...

What I am saying is, as they have registered with an EU competent authority before the end of the transition period, the CE approval under the old regulations will still apply after 1 January 2021 - despite the devices not having been offered on the EU market.

Had they not done so, they’d have had to apply for a fresh CE mark, via an approved body, under the new EU regulations and for subsequent registration with an EU member state competent authority. That would be a costly and complex process.
