So

The deadline for applying for an SPC is the later of:

6 months from the date of grant of the basic national patent, or
6 months from grant of the first marketing authorisation in the country concerned, whichever is the later.

So as long as whoever has the drug applies for the SPC 6 months after authorisation, the patent lasts for at least 10 years after this and possibly an 11th year. After this we are then into ever-greening games.

I find it hard to believe that a generic drug can go to market before the original drug is marketed. But I may be wrong.

On the question of how long the patent for SCIB1 will last, I posted on 22 Aug this year.
So, by my reckoning the patent lasts 10 or 11 years in Europe once marketing commences.

Knowlesi's original concern was the patent in Europe I believe.
The above link describes a possible 5 year extension in Europe (similar to the US).
And remember we already have a 7 year extension in the US courtesy of our friends in the FDA granting orphan designation.

The paragraph on "data exclusivity" is interesting.

If I read it correctly, it means that from marketing a product

a) 8 years before preclinical and clinical data is released
b) A further 2 years before a generic product can be marketed
c) A further 1 year if significant changes have been made to the original product (e.g. SCIB1+)

So we certainly look safe for 10 years from first marketing of the product in Europe with a probable extra year.

I would be surprised if we see a deal on Moditope pre-clinical. They have come so far with the trial soon to start, so definitely better to wait for data IMO.
The other thing about the 33 targets is that some may produce a response from either Modi1 or Modi2 or both.
Reference one of my recent posts when researchers were postulating citrullinated targets for colectoral cancer whereas Lindy thinks homocitrullinated targets are a better bet. So this is evidence why Lindy is excited about combining Modi1 and Modi2; some cancers express both types of target.

Here's a recent Nature article about citrullination and colorectal cancer

The first sentence of the abstract says:

"Citrullination of proteins, a post-translational conversion of arginine residues to citrulline, is recognized in rheumatoid arthritis, but largely undocumented in cancer"

Really, I think these researchers need to dig a bit deeper. No mention of Scancell, moditope, or Lindy Durrant.
At the time of this article, Scancell's Modi1 citrullination patent had already been granted in Europe.

Actually, Lindy and her team think Modi2 (homocitrullination) is a better bet with 2 peptides already identified.

The SCIB1 trial data got better and better but the SP slowly eroded because a deal did not materialise.
RG said at the AGM that the door was closed. Cancer vaccine, no way, go away Scancell. Come back when you have a TCR product, or a CAR-T product or an mNRA vaccine. It wasn't sexy science.
