I think a reasonably fundamental principle is that if one has to pursue anyone, to this extent, for redress over anything, the defendant is not usually the sort of person/agency/whatever that will just pay-up.

However, in this case, if RKH does win their claim, they would have the authority to seize assets to the value of the award.
RKH and their lawyers have very sensibly chosen the USA as the enforcement jurisdiction, so as well as there being plenty of assets to seize, the process is likely to be successful and not too long drawn-out..
Facing this, the Italian State may decide to pay-up, rather than have valuable assets seized. It'll still take time, but maybe not as long as some here suggest.

Of course, we still need to know the outcome.

BOR could well go ahead one day, for the reasons I've already stated in other posts (I suspect you're just copying my homework HI), but not until SL has been sanctioned, the infrastructure is in place with SL producing some revenue.

The Italian State agreed to respect the outcome, when RKH referred this issue to an international tribunal, which announced its judgement in June 2019 in favour of the RKH arbitration claim procedure.

That judgement remains as it was, no matter what the CJEU, the Italian State, Uncle Tom Cobbley, or even Godders tries to do.

I think if dates are given, which aren't met, an explanation is essential, if management is to be believed.

I'm sure Sam & Co. were caught out on this occasion, but having given a date, then explain why it hasn't been met.

We've had this a few times earlier, such as TD saying FID would be within the next 6 months, etc., which didn't materialise, causing a great deal of mistrust.

Continuing in the same way does nothing to instill confidence that this time, management is trying to get it right.

The CJEU ruling has been known for a few days now.

If the reason for the delay in announcing the RKH arbitration award is because it was considered sensible/necessary to await the CJEU ruling, then shouldn't RKH BoD have issued a further RNS statement about yet another delay, having only just made a statement about the award's imminent announcement by the end of July?

Presumably Sam & Co. would have known that the further delay was because of the CJEU ruling?

Once again, sloppy management with no regard for shareholders, or anyone else who might be interested in such a crucial announcement for the company's future.

My recollection is that, while the UK was still an EU member, the Italians had requested a suspension of the arbitration process, because it was an intra-EU claim. RKH referred this to an international tribunal. In June 2019, the tribunal ruled against Italy, that RKH's claim was valid, which remains the situation now.

This new CJEU ruling applies to intra-EU claims, but as well as the June ruling still being valid, thhe UK is no longer an EU member, so I can't see how this latest ruling can apply in this case.

In any case, the sp would have completely plummeted had this new ruling (which has been known since last week) applied to this case - wouldn't it?

Actually, the word is 'semantics', which is not the case here, as a Court case and an arbitration tribunal are very different.

However, I think it's just too valuable for HBR to let go and it's too much revenue potential for the FIG to let go and it's too much revenue potential, prestige and strategic value (that's the FI) for HMG to let go.

I would agree that it could be embarrassing for HMG to provide UKEF funding around the same time as chairing COP26 (although, when do you remember Boris ever being embarrassed about anything?) - it's more a matter of credibility, if UK is going to set the eco-baseline at COP26 and immediately facilitate SL through UKEF.

However, there's more to this than UKEF alone and I could see HMG facilitating "developments" in the FI region, such as helping to build that larger port, and or other infrastructure projects, plus guaranteeing defence support in the area, which costs a great deal and would reassure HBR that this is a safe region to commit so much investment.

So I wouldn't focus unduly on UKEF, even though that would have been the obvious solution. With the 40th anniversary approaching and Boris looking a bit of a buffoon recently, I can see him doing a Thatcher, gaining public approval by some grand gesture in the Falklands. The colonial Brits just love that sort of thing! I can hear them singing "Rule Britannia" as I post this.
