In respect of advice, I doubt their lawyers are claiming they will win, just that they might be able to convince a jury that they didn’t steal any IP or if they did they did so unwittingly (and avoid multipliers). I don’t see what’s so hard to grasp here.

If the lawyers think they can win it doesn’t matter if they consider themselves liable or not so why settle? It’s pointless unless the lawyers advise Samsung there’s not a single hope.

Honestly I don’t know how you think!! I didn’t say they have. Zero regard, I said they think they can win. Why the fk would they just give Nanoco money on that basis? If they do lose I’ve laid that out before. There are at least 2 outcomes that are favourable for Samsung and only one is punitive although to what degree we won’t know until the end.

Sammy- I just don’t think you are able to entertain or comprehend the concept that Samsung are going to court because they think they have a defence. They aren’t thinking about avoiding multipliers to save money, they’re trying to avoid paying out anything at all and going to court, even if they lose actually allows them to save face. They would pay up, eventually but not before making it known they don’t agree with the judgment.

But what difference does it make? Really? If you are told tomorrow or next month the only difference is you have to more patience. Yes of course we’d like to know but I don’t understand how trying to somehow force the process is going to make the slightest bit of a difference.

Rightly or wrongly.
I said before.....
1. Best case for Samsung? they win
2. Mean outcome? pay the licence agreements plus royalties they could of had to pay anyway + interest
3. Worst?- wilful multiplier

It's worth the risk. There will be no settlement unless Nanoco are willing to reduce the claim.

I’m waiting for confirmation of visibility of commercial orders next, not the trial.

I’ve been mulling this over for a while. Firstly I’d be delighted with an out of court settlement, who wouldn’t be from a risk free instant reward perspective.

But let’s assume the parties are in communication and during pre-trial the judge effectively advises Samsungs lawyers that their defence case looks weak, how are they likely to receive this ‘guidance’? Let’s assume they are working to a directive and a strategy formulated some time ago with Samsung senior management where it was agreed that in their opinion they have a strong defence/case then they won’t accept JG’a guidance especially when there’s the human factor-the Jury.

All conjecture but I’m still of the opinion “we’re going to trial “
