It all comes down to risk/reward. Suppose you were offered $500m to settle and thought you might only win $1bn at trial on an outcome decided by a jury? I know which one I’d take.

If you are very confident of winning then you will assign the risk as very low and go to trial. Or if the potential award you’ve decided is significantly higher at trial then maybe the funder is risk positive. It’s their business model after all.

I still think this is going to trial and these discussions will be moot but happy to be proven wrong.

A settlement decision doesn’t have any impact on the case if the case doesn’t proceed Sammy. I’m not suggesting the lender influences the trial at all. Only that if a settlement is tabled they’re going to know about it and be involved in the decision process.

Sammy88…..I’ll give you this - I’m in contact with NigWit on a frequent basis and have been for many years. But currently I’m walking on a beach in Turkey and he’s transplanting wildflowers in the UK. But you conspirators keep on making assumptions as I can no more prove this here than I can convince you you’re being a little naive. It would be much easier to read between the lines as I have for example and conceded previously that I think we’re going to trial but that a settlement would be a welcomed outcome. Don’t become entrenched just because someone disagrees with you. At least consider it first ;-)

If you think they have no say at a decision on accepting or not accepting a settlement offer then you are off your head. That’s what I’m saying unequivocally . If you argue this I’ll take you and your attempts at ramping even less seriously, if that were possible.
