Maybe I didn't express it clearly BBN. This is the version before, not after, they reviewed and amended it, so we have we have not seen the changes yet. I'm hopng we get sight of the new version today. From reports yesterday we already know:
- 8% free carries for employees and community reduced to 5%
- 5% community element can be delivered directly by company to community without local govt interceding (good!)
- 1% charge on profits only applies when company is paying a dividend
I'm sure there are other things I missed yesterday, and more yet to emerge.
I shared it because it added greatly to my understanding of the scope and intent of the charter, and I'm a bit surprised that given how material it is to BMN and us, that there hasn't been more discussion on here.

Two things: First I found this - https://bit.ly/2ps7xe3 - comprehensive brefing in the mining charter (the version that the SA cabinet reviewed and amended this week) written by Deliotte. We will be learning more about what has changed later today, I hope, but this is a good source for those interested in the detail. I've only skimmed it so far, but it gives some good clues about why there is so much mistrust in the industry, and paints a good picture of what should be happening as/when organisations comply with the spirit of sharing the benefits of extraction and benefication, not just box ticking. It also points out the main areas where there is a lack of clarity and even conflict with the broader BBBEE policy requirements.
My second point is that I'm not clear about is how the provisions in the charter that directly affect the workforce - in particular the 1% profit share proposed when the company is paying a dividend - impact on the current dispute. Might they go some way to resolving the dispute? Any thoughs?

I met Fortune for the first time in 2013 and at the time there was an entity with a significant shareholding, the principles of which were not known to us mortals. Can't remember the name of it now - others may have better retention....
Anyhow I asked Fortune who was behind it and he mentioned Borromeo (HK based UHNW guy, ex-fund manager) and Percy Barnevik (ex CEO of ABB). He described them both as being very supportive - or words to that effect.

They could even make the granting of options proportional to production volumes vs target.
The opporntunity here is to align the interests of the workers with those of the management and the owners (us).

It has occurred to me that the mysterious shortfall in the yields in the ore processed could be another symptom of the same disease.
