Once again you have not read the Requirements that Tanesco now operate under. the AG has made it clear they follow the procedures set down in the Tender Procurement document introduced in 2013

That as many as 40 plus guys or 40,000 working on the PPA does not influence the requirements laid down by the AG.

How do we know it is the AG. Because the next step for the PPA from Tanesco is to send it to the office of the AG. The AG has in effect asked ''where is the the tender procurement document issued in 2013. it is not a suggestion it is a requirement.''

Hence we are now where we are

IF Tanesco had their way there would be no tender procurement document. Indeed if Tanesoco were instructed to follow the Procurement document issued in 2013 at the very start of the Kibo unsolicited approach. Then I suspect we would have followed that path.

where i live and work the law is what suits those who choose to make it what it is. Supreme court here is not allowed appeals against as per constitutional law. yet regularly only reversed its decisions, on one case did so 5 times, etc

I believe it is possible to appeal. I see that happening in Se asia all the time. Losers never lose, they are always cheated and the process corrupt, that is the basis of their legal challenges.

Be nice if Tanzanian law prevents that. I do not know what Tanzanian law is in this area.

I suspect DW is considering adding to our real estate position at the end of year SOA land lease auctions. I would not be surprised if he wants to add more acres around WINX and Yukon Gold, Yukon prior to release of 3D. He may even wish to add more contingent acres around Ice wine. Then we get the bid winners and losers announced. Here lies the danger. Kibo bid not accepted bad enough!

Kibo bid accepted, and sore losers decide if they cannot win, then no one can. They take the appeal, through legal hoops that could last years. At Least there is no BITS to muddy the waters for any well connected local firms.

Yet i suspect that SEPCO have a far larger agenda to manage. If tanzania was no longer open for such Business then i think SEPCO would happily wander off into the sunset and take their financing to some one who does want it. Maybe Botswana and mozambique plus the UK.

I suspect they cannot issue an SMl unless they now require EDL and tancoal partners to submit a new SML each as they both are looking at mine mouth power? they are already behind Kibo on documents needed, quite a long way behind.

AG has stepped in and made it clear that following Tanesco losing a Procurement court case that the Procurement requirement laid down in 2013 are to be followed and not to be treated as a mere suggestion.

Refer to Paragraph 4 of the procurement document it could not be more clear.

Suggest you read the Q & A again with particular reference to the reasons why ALL procurement are to follow this process. Clearly the new AG has made it clear to Tanesco that the Procurement Documents brought in 2013 are not suggestions they are to be used as Tanesco have already lost a legal challenge by not following procurement requirements.

This is NOT a Kibo specific measure as confirmed by EDL and Tancoal partners. We do know that two other projects have stalled at costs. Yet neither have been advised as award winning or the best that Tanesco have seen.
