CTDA approval - this is on the way. ODX have gone past any HMG contracts. Instead they will be selling via DAM clinics, into Europe and I would strongly wager they have already applied to the FDA. As I have said all along they have an American Director on the BOD who is influential so do not be surprised when they announce they have won a very lucrative contract.

With regards the equipment they were loaned, this will be too much trouble for HMG to organise a return. It is now second hand which ODX could arrange to pay at a fraction of price when sales land and which will become an asset on their books. Looked at their HMG contract and as far as I can see they fulfilled the contract by spending the £2.5 m and more of their own capital to ready a facility for manufacturing. 99% sure they are not legally bound to return the £2.5 m

FDA approval would certainly be a good approach. As for the equipment it will now be marked down in terms of price, it being deemed second hand so effectively ODX could pay HMG back at a much reduced cost from the proceeds of sales. The equipment then also becomes an asset to ODX. All it needs is for a few to be creative. All is not lost but ALL to be played for IMHO

philg65 - the delay was due to further questions from the application. To be fair if it was a NO they would have said so at the time. I believe they publish evaluations/approvals each Wednesday.

For CK to stop abdicating authority. He needs to pick up the phone and progress his application for evaluation and approval. The SP IMHO will start moving North once evaluation and approval has been received.
