No, not in the sense of a formal court requirement.

The defendants do not have to lodge an "application to settle."

Settlement can happen:

Informally between lawyers.

Through negotiations.

Through mediation.

Through offers made under the relevant court rules.

In fact, most settlements occur without any special application being filed.

What the court may do at Case Conferences is:

encourage ADR (alternative dispute resolution),

ask whether settlement discussions have taken place,

direct parties to consider mediation.

But that's different from requiring a settlement application.

In your GST/Semnet context, if the defendants wanted to reopen discussions, they could simply have their lawyers contact Semnet's lawyers and start negotiating again. The court might never know until a settlement is reached.

Morning all - only a few hours remain for the defendants to appeal the stay refusal.

Given the applications were dismissed in their entirety, and the Case Conference was allowed to proceed on 4 June, it's interesting that no stay-pending-appeal application appears to have emerged to halt the proceedings and stop the litigation gaining further momentum.

The defendants and their advisers have had nearly two weeks since the 26 May ruling to assess the Registrar's reasoning and prospects of success.

Whether an appeal has been filed remains to be seen, but the timeline is certainly worth noting.

Why do they need to appeal chbs, what happened to their cunning counter claims? Unless the registrar made one huge balls up with a simple fact they will absolutely struggle to win an appeal and even less chance of getting a stay to appeal until case heard.

The defendants can only argue that the claim is protected by the arbitration clause. But how can they possibly be successful if semnet are making a broader claim outside of the SPA? The registrar identified this and rejected the stay applications.

It's an uphill battle for them to successfully challenge a simple fact - its either inside the SPA or it's not... the registrar can only make her ruling on this basis. And she did just that.
