I dont see the big deal if they've appealed or not the proceedings are progressing anyway. And it's more unlikely to get a stay until appeal heard especially as the case is already moving forward. And it's not like the case was partially stayed it was rejected in its entirety. So if they do appeal it doesnt slow the proceedings down at all. The defendants are under pressure now which is why they were so desperate for it to be returned to arbitration. As chubby rightfully pointed out "it's a great advantage for semnet and all shareholders"

If they do appeal enki, it's less likely they will get a stay to appeal to pause the case as the proceedings have already progressed past the case conference so the proceedings would likely continue alongside any appeal.

If the parties reach a settlement, they do not need to make an application asking the court for permission to settle

They can simply agree terms betweer themselves.

After that, their lawvers would usually do one of the following

• File a Notice of Discontinuance (claim withdrawn)

• File a Consent Order (agreed order signed by both sides)

• Inform the court that the matter has settled and ask for anv future hearings to be vacated

The settlement itself is a private agreement between the parties.
