It looks like Lars is fashioning a very strong sales team here. With this new focus at CAP-XX and the joint venture with Ionic Industries (which is gathering pace nicely) the future looks very good. These are not the actions of a company about to sell itself for measly $10m.

This one looks like a no brainer if you can view beyond 12 months, the semiconductor industry is going to have huge growth over the next decade. ENSI is another one I'm expecting to do very well.

Also why would the BOD accept a $10m buy out proposal when they are expecting far higher pay out from the court case.

Not to mention that in 18 months annual revenue will be exceeding $10m and the company will be profitable, so a $10m offer significantly undervalues the company.

Towns - it's in the court documents. There was a large brief using various formulas and analysis of calculated damages. The figures are all redacted but essentially this is what the experts are / were arguing over. The deceased witness being one of those experts. It seems both sides are happy for it to go to court and let the jury decide how much the damages should be.

If they are found to be infringing then they will have to pay 5% royalties on sales of the infringed products.

The court would work all that out but that's way down the line if at all.

Also on current sales 5% royalties would only amount to a around $100,000 currently.

Looks like someone loaded up today.

I also took a small position last Friday.

It's a punt but I'm happy to sit on it for 12 monthts to see how it pans out.

They are notifying on their total position which has decreased below the 5% threshold.

Their spread bet has been reduced but they have added an additional 415000 shares to their direct shares position.

That's correct MikeCC, CAP-XX are after royalties for that entire period until expiration. Also because it is wilful infringement the final sum will be tripled and court costs added.

Judging by the court docs this is what the two sides are arguing about how much the damages are.
