So Lusorecursos is on the same pathway as ourselves in Article 16. APA issued the note which I found interesting esp 7 and 8.
6 - The DAY is issued by the AIA authority, within a maximum of 50 days from the date of termination of the suspension, except in the cases provided for in the following paragraph.
7 - If the AIA authority considers that there are grounds that justify the issuance of an unfavourable DIA, it must send to the member of the Government responsible for the environment area the respective DIA proposal, up to 10 days before the end of the deadline set in the previous paragraph.
8 - After the dispatch of the DIA proposal referred to in the previous paragraph, the member of the Government responsible for the environment area has 10 days to issue the DIA.
Do I read from this that in the event of APA finding against, it has to be referred to the Government 10 days before the 50 working day deadline so that the Government can make a political decision on any go ahead, effectively by-passing APAs likely decision, albeit on the Government’s head.
Can just see the EC being happy with a no to SAV at this time, following the recent endorsement from a smiling Sefcovic who was gushing in approval of Portuguese Gov general support. With the CRMA due to be revealed March 8 and the revised submission a week later, mid May will be an interesting period.
