The basis of that judgement fall along these lines.

"In one FOS case that was resolved in favour of the consumer, the buyer was found to have been charged 5.5% when they could have gotten 2.49% without the broker's commission.

The lender was told to pay the consumer the difference between the payments, plus interest on each overpayment at 8%".... Most recently.

25 October, the court of appeal ruled in favour of three borrowers filing complaints against FirstRand Bank and Close Brothers for potential car finance mis-selling.

The ruling determined that it was unlawful for car finance companies to have paid commissions to car dealers without the borrower's knowledge.

"In Johnson v FirstRand Lady Justice Andrews, Lord Justice Birss and Lord Justice Edis allowed three appeals finding dealers, by acting as sellers as well as credit brokers, owed car-buyers a ’disinterested duty’. The judgment found ‘the relationship was also a fiduciary one. In all three cases there was a conflict of interest and no informed consent by the consumer to the receipt of the commission.’

The Supreme court is now allowing an appeal.

I never had the finance to buy a car myself choosing to buy them cash. For years I've had a claim for the emissions scandal, which I was thinking would be straight forward as in say the USA a huge settlement was made. But of course that not the Uk and our rather lets say wishy washy consumer rights laws.. That is until it seems to match a wider agenda. You know what I am saying?

I watch the programme about the 1200KM Norwegian gas pipeline. How they had to sink a 1000ton rig 1000feet deep and work remotely in a 3d modelled room of the sea bed. It has to work flawlessly for 40yrs. Special lifting machines built and a whole town transformed..
