Yup.....but they only have until June 19 to claim on the escrow. They can hold out as long as they like but on this aspect the clock keeps ticking.

Personally I see us getting more than half the £53m back. £37m at least. If SGH had had such a brilliant case they would have launched it well before now. Don't forget they didnt even notify WTG of a potential claim until the last day which was contractually allowed and even now there is still no claim. On our side we have an peer-awarded lawyer who was intimately involved in the PSD sale, and a QC on the board......against a company full of lawyers which is on the rocks and who put 70 on the due dilligence which they admit themselves was world class.... See you in court. ;-)

@sparkles2000, for me it seems clear: the underlying business is being dealt with and it's turning around. II's also clearly like what they see despite some of us PI's expecting something different. So my own catalysts for an increase in sp remain what they have been for quite some time:- - Resolution of the escrow being released: the timelines at least for movement one way or the other are immovable and less than 3 months from here - Resolution of the SFO enquiry.....Trump may be out of office by then, - Dropping of the alleged potential YLF claim (which is dependent upon at least the SFO enquiry since clearly they have no grounds of their own upon which to base a case) Until then I'm happy (probably the wrong word...more like 'comfortable') to leave my significant (for me) holding in place. Of course I'd like to see the sp well above here; of course I'd like to see an RNS about a significant win.....but until then I like the way the team are running the day-to-day business. Then again I'm just a simple Scouser who may be completely wrong....time will tell.

They have 9 months from notification in which to initiate a claim. That's not negotiable. As of the close of Friday they have not: or we'd see an RNS. There may if course be ongoing negotiations to avoid a lengthy claim. Personally I doubt that as it's not in WTG's interest now....SGH are under mind-blowing pressures. As I joked on Friday: see you in court. Your move. Australian barristers are demanding upfront costs from SGH as they're 'somewhat short of funds'. We are not. June 19: make a claim or the escrow is released.

We'll know what's happening by 19 June at the very latest. Either way.

This all makes for an interesting negotiation process. SGH will anyhow have made a claim for significantly more than they expect to settle for: from the start my guess has been £15m. Now, however, they're is a bit of a diddle and certainly pressed for time. I wonder what our opening offer might be? £2m? £3m?........or just 'See you in court'? I'd love to be sat at that table........

I agree with not wanting to wait for a court decision, and had also forgotten the recent article about the barristers group from Victoria who have warned to get pre-payment before taking on work from SGH. So all the banks are now out....... My immediate thought is that once this is resolved they will then focus on grabbing as much cash as possible from every possible source, including the threatened claim against WTG. the funding which is being put in place will surely demand this. They've three months left to initiate it so we're closer to knowing............either way.

You could be right lindoser although I think it's simpler than that:- - They report only what & when they are required to, so any relevant wins or losses which fall under the 10% rule would also be reported - The claim against Aviva is big enough to be deemed relevant so was reported - They're not interested in attracting more PI's....just building the business where more II's start ot invest In order to do that theyre focusing on the business whilst the three remaining legacy issues play out.
