I am much more relaxed than after reading Starrages initial comment and the my first read through of the court assessment. It seems to me it's been a shot at taking Hope down and off the board, driven by personal vendetta or biased interpretations of his actions (unless discovery is known to prove otherwise) supported by the fact that Hope can't practically take the assets if he wants to see the return on the notes - due to the Georgian government. Further more this court action is also underpinned by the (hopefully agreed) New York loan agreement for 60 million to wipe out the notes. It doesn't really matter about how the debt is restructured if they can be paid off immediately.

I had a quick scan of the document again and didn't see the part where it said about hope being limited to the $2million interest? can you give me a heads up to where it is? Something like this takes a about 5 reads to sink in properly (for me)

I'm no legal eagle but if evidence found in the discovery was mentioned or used in this ruling would it not be mentioned as the source of a particular bit of information eg like emails or the affidavits mentioned. (assuming any of it was used)

I also wonder if point 38 which is highlighted by the judge as the 'highpoint' of FRR's evidential claims will have any potential leverage in the OOC as the judge says it could support an entirely separate legal case in itself if proved sufficiently

Guessing after an OOC settlement has been achieved. Heartbeat is now at normal levels after that and I haven't even left 1 skid mark either. Back to the waiting game

In the document it basically says if Hope tries to seize the asset as payment the Georgian government step in and outrider won't get a return on their debt, which is why he pushes for ooc at the end of the document.
Was this all a play for time to get the loan to pay off outrider without him vetoing it?

An ooc not in frr's favor? Was this a stalling tactic for the loan? Why was YA restructure deemed so leniant if not for evidence against Hope? Short term cash flow issues or box ticking for the loan agreement? I have literally no idea what is going on. Those last few pages of the judgment make very little comfort.

I agree, from what I have seen and read consolidation usually has a net negative effect on company sp. However, consolidation while delisted will have no measurable affect and is seemingly the most ideal time to do it as it will be more than completely nullified by the various expected positive news factors to come when (hopefully) relisted.
