Agreed, appears on be fairly standard request for info to avoid "ambushes" at the trial.
Interesting the Gov are showing a reluctance to provide the information.
Maybe they do have skeletons in the cupboard..

BigB, problem is the Law, and moreso US Law is not black and white...
We may well have an excellent defence but not necessarily be found innocent.
Further to which, the BOD are not lawyers and they
will be guided by Counsel as to the likelihood of success.
Unfortunately, lawyers will never never be definitive in their opinion of an outcome in a trial of any nature, no matter how overwhelming the evidence in your favour may be.
They know that certain evidence may be inadmissible once they get to Court or late new evidence may be allowed into the bundle AND last but not least they always cite the Judge himself may see it all different.
So, what I am saying is that the BOD will ultimately call the shots but this decision is being determined by the Lawyer’s advices.
My read is that they are being advised to take it so far so the DOJ have doubts as to their case may not be watertight and by casting that doubt in their minds, this will then hopefully put them on the back foot in the settlement negotiations.
It’s all a game of brinkmanship and goes on all the time.

BigB, I was for a long time thinking of possible dismissal but have now tended to side with the idea that even if we have a good argument to defend the case, it still may well may make
commercial sense to try and agree a reasonable settlement figure and then move on...
Anything under the provision will result in a
SP spike...

The indemnity agreement reads a little different to my previous perception.
I felt the indemnity was RB’s obligation to indemnify INDV for all costs prior to the demerger as the current INDV had minimal or no control of the decision-making process within the Group as it would have been just a division of RB at the time.
But the devil is in the detail....

However, the 2nd payment is to cover potential State claims whilst the $1.4bn was in settlement of the Federal Indictment.
Now that poses another question, are there any State claims “lying in wait” for INDV...?
Will try and check this out and post back if I come up with anything.

Jack, don’t think we should rely on the US Gov worrying about bringing a Co Down, they did it with Purdue, although they were charged with creating and sustaining the Opioid crisis, the. They then went for over $3bn from the Shackler family themselves.
Don’t think this can be applied to INDV, but the fact sentiment does not come to the fore can be worrying.
But let’s not scaremonger as the indictment started off @ $3bn, they have already banked $1.4bn so very very worse case scenario is $1.6bn and we have $1bn in the bank, with the possibility or even probability it will be far less, so don’t believe the same fate as Purdue is evens remote possibility.

Did not ask on length of the process but “Mayday” is actually May next year for the hearing.
Anything can happen between then but they just need to be building up the watches for a settlement although indications, so far, is that they will fight it.
However, maybe this is them just fronting up liking for chinks in the DOJ’s armour.
Of course the dipping SP is of concern but anyone can jump ship at a loss and that’s not necessarily the best policy especially if there has been no material change since you invested.
Makes sense in the back of poor trading numbers or other detrimental news....but there is none of that, so I am sticking by all the reasons for my initial buying....

As I have mentioned before the low SP only becomes a problem when you are looking to sell or have to sell.
Nothing really has changed since this was at 65, OK the Motion to Dismiss was denied, but realistically that was never going to happen, as I posted after speaking with Investor Relations, this was part of the process they needed to go through with little likelihood of success.
Not forecasting any SP movements but my own investment speaks for my opinion.

Not so sure about the “more to come”
The Market Cap is much too low, considering cash in bank and positive trading..even with the DOJ problem waiting in the wings.
Whilst no-one can call the bottom, I personally would be very surprised if you are not nearly there or even there now.
Admittedly sentiment plays a major part in determining the SP but in the end common sense prevails.

Whilst the webcast is fairly positive , there is absolutely no new revelations that would indicate a “strong buy” .....
Never ceases to surprise the first time posters (under their new name) come out with these “advices” and actually expect people to take it onboard ...
