numbers, so a lower SP shortens the odds for a rise.
The sale of Furnace has some advantages, certainly more than the negatives IMO...
Think the gamble maybe fairly short term this time around as envisage quite a bit of new volatility with the SP over the coming weeks which will determine our fate....the ball is very much in play and the game is on...

JD, no legal expert myself but this is neither with us or against us as it is simply a motion (request) to dismiss certain aspects of the evidence.
Even if we get judgement in this it is only a moral victory, with the real battle still to be fought out in May.
Having said that if we were to win a number of small victories in the build up to May it does strengthen our case but not sure if we have actual won any so far...

One glaringly stupid element of their argument when referring to certain docs is that they “don’t know if they exist”
This must fail on that alone, how can they deny access to information they THINK they don’t have.
That is no defence, they either have them or they don’t and as they appear to have been used to produce reports/advices/guidance by Government Agencies then they surely exist..

In the UK the the common practise for the
“Costs to follow the loser”
Would imagine it is a fairly worldwide
arrangement as it does make for a common
sense solution.
Although Judges can determine otherwise in
certain circumstances.
Looking at the positive side, if it goes to Court
and we were to win, we would claim all our costs
from the DOJ.
And in answer to Eviking’s post, don’t think even Indv have a handle on the costs, which are ongoing.
However, fair to say that we would be into a number of millions already and increasing daily....

Morning Manifesto, Totally agree on the fundamentals, innocent until proven guilty. The onus is on the DOJ to prove guilt.
However, just on the GJ decision.
It has been decided that they have a “Prima Facie” case, which basically means on the production of basic facts it “appears” they are true unless proven otherwise..
The DOJ have got over the 1st hurdle and now they have to prove the “facts”.
Obviously we have to refute the allegations, hence it goes to trial.

Interesting comparisons, however a couple of questions it poses, are they debt free because they cannot get credit ? Or do they just find it easier to go to the Investors for a hand out ?

So we can call it but have to prove it...

Thing is if they settled for anything under $500m tomorrow the SP would likely double..and that would be a good result for most of us..
