I am pleased that the company gave an update - best to keep the market informed. As frustrating as it is, the Greenlandics will go through their procedure. There are Danes, with experience of Greenland, amongst the management.

Plface - it is detail in the writ and particulars of claim that is material. Over the weekend, I found a typical clause that I was referring to but it would take me time to type it out. The reality is that we are at a disadvantage in not knowing the detail of and in the claim. PS - I would not give up on Georgia not that I know anything about the current position.

I do not have a precedent at hand but a typical boiler plate clause in a contract is that the contract is the full understanding between the parties and includes anything in discussions between the parties leading up to the contract. In short anything else which may have been discussed has no relevance.

So the contents in any heads of agreement are absorbed in the contract and Platina cannot rely on them if any aspect has been omitted in the contract.

Well put Caterham . Unfortunately we do not have the detail upon which to judge.
I still believe that common sense will prevail in that a deal will be struck between Artemis and Platina - far preferable to long protracted and costly litigation.

Manlord - the terms of the agreement between Artemis and Empire Metals may be binding but it is subject to third party consents. I assume that the consent of Platina is required. If I am correct instead of giving its consent Platina has thrown a spanner in the works.
Surely the question which needs answering is whether Platina do or do not have a valid complaint and not whether it is a "try on" and not whether the Artemis/EEE agreement is 100% binding.

In my view it would be unlikely that the Court would strike out Platina's claim of its own volition. However as you say it is open to Artemis to apply to strike out Platina's claim. We are at a disadvantage in that we do not have sight of the claim nor any document under with the claim is based. I personally think that there will be a deal. It will not suit Platina to prevent the Artemis/Empire deal proceeding in that Platina's interest could become more valuable with development. If the deal does not proceed and Platina insists on forcing a buy out of Artemis's interest whatever that amounts to, do they have the money to develop Munni Munni on their own or who would become their JV partner. The lateness of the claim leaves a bad taste.

If Platina are wise they will reach a settlement with Artemis. They do not have money to burn on lawyers and litigation is expensive.

Don't worry Dip!!! I fully understand what you were saying yesterday and I am sure that MrCautious also appreciated what you were saying. That said, I think that there are some who are impatient for news about how the tie ups are progressing which is also understandable; news vacuums always instill nervousness among retail investors.

cashfornuthin - we are not privy to the paperwork between Artemis and Platina and I am not sure about the ASX disclosure rules. With that in mind and given the left field writ issued by Platina not long before the drilling results are to be submitted to I believe Global to investigate and report to Artemis, I ask myself whether I would expend the cost of reviewing the results and press for and disclose the results. Do we know if Platina are contributing to the cost of the drilling and testing - I have seen so suggestion that Platina have.

I and it would seem others are none too pleased at the fact that Platina has left it so late to file a writ. I wonder in the circumstances whether first Artemis might apply for summary judgment to strike out the claim and /or counterclaim for the ongoing damage caused to Artemis arising from the delay in progressing development of Munni Munni.

Empire are not however a party to the proceedings unless they applied to be joined to the proceedings.

Thank you Dip and Mr Cautious for your frank exchange of views; also to Dip for an insight as your commercial past. Dev has some sophisticated investors with large stakes; the latest being Sami Vanderlip. But at the end of the day it is up to the company's management to deliver. There are two expressions which I always keep in the back of my mind. The first is "walk the walk and not just talk the talk". The second is "under promise but over deliver". As shareholders of whatever sized holding, I/we look forward to an update of how the company is progressing, the prospectus and the half year report.

Because the dispute is between Platina and Artemis. It may be that Platina will have to put up or shut up. Platina had a recent placing but did not raise much. Litigation is expensive. Quite possible that a deal will be done to resolve the dispute. Platina are in effect a sleeping partner. I stand to be corrected but Platina do not appear to have monetised anything and have a motley group of four interests.
