Hope is clearly resisting discovery. What is there that he doesn't want found?. We have our theories about naked shorting, collusion with YA etc. There might be other things or nothing. If any of that is there then forcing discovery could be the key to unlocking an oocs or Hope losing out in a major way.

Timster - Not so, I've said before RR is a legend and gives us encouragement and positivity day after day. Long may he continue to do so in these uncertain times.

Just catching up on posts - bewildering. Let me summarize - I want to win this case so whose side would I be on to be the winner, Objectively it has to be Frontera, Hope has too much against him and could be a big loser if any criminal wrongdoing is discovered. Simples.

Remember Californian discovery has yet to take place.

Regdik - Two words wrong in your last Paragraph. For FRR substitute Hope and in the last sentence "we" should read "he".

On a lighter note Occidental have agreed a 55bn buyout of Andarko. I wonder what that makes B12 worth?!

For Hope to reverse the position he has to not only litigate to undo the 5% transfer, but in so doing take on the GG as well as FRR in a separate case costing serious money and a lot of time. - good luck with that then!

Zeps - Paying Hope off was just not what he wanted, he wanted the Company and therefore made it impossible for him to be paid off with any remotely acceptable terms. By breaking all the fiduciary rules along the way Hope has overplayed his hand and made this process we are now in necessary in order to resolve everything.

Tsbs - Hope is not a "normal creditor" , he has broken many rules of fiduciary duty to attempt to maintain the primacy of his loan to the detriment of FRR . Try not to see things just in black and white, this is an ongoing process and I am fairly relaxed about the progress so far.

The Judge has already signed initial directions, ergo it is before the court.

The case is now before the court. Anyone trying to mess with the submissions or attempting to change matters unilaterally would be in lot of trouble. No lawyer from either side would attempt it.

On the 6th June the two lots of lawyers will come before the judge. The Judge will learn a lot more from this encounter than reading endless documents. This is a very positive move and one which if I were the Judge I would regard as essential to understanding the case. There is nothing negative in this procedure if we have confidence. - We do don't we?!

Application for injunction and discovery going for hearing on June 6th. Seems ok to me.

Nobody knows, it's all guesswork nothing more. Most of it is opinionated ignorance I'm sad to say. Real information would be a blessed relief!

I posted last night about pipeline contamination in Russia I thought it may be a gas pipeline but it relates to oil.

I've just been informed that the main gas pipeline from Russia to Europe seems to have been contaminated and sabotage is suspected. Anybody heard anything on this. I'm on phone now so difficult to check

This can be such a good BB. Thanks to all those who who spend time (and money) to dig out the information to keep us all going and allow amateur analysts like myself to speculate on the basis of fact not fiction.

Just another thought that if as we suspect there has been some doubtful arrangements (being careful with my language) between YA/ OMF/Hope relating to short selling of those non existent shares and YA have indeed provided evidence to FRR about that then that could be a killer blow to Hope, because we know he was desperate to get hold of a chunk of shares

The big advantage of having an open trial is at last we will get to see all this but I wouldn't be surprised to see Hope settle before any trial. He's in a fairly deep hole, he really should stop digging.

WHamBoy - That's right Hope would have had to respond with almost an instinctive reaction to what would have been a shock move that mirrors that of the original Cayman action. A jury trial is much to be favoured over what Justice Kawaley could deliver, as well as putting the highest pressure possible on Hope.

So far an oocs has not proved possible but a jury trial verdict imposes a settlement on the parties and if Hope is willing to stake his future on that it is risky in the extreme. Far from being pessimistic about this I think FRR are in control right now with Hope just reacting to events.

I see we have the usual raft of speculative bo***cks being posted that serve no purpose other than to increase the level of frustration. There is no point in this whatsoever.

Points of view based on fact are ,of course, always welcome, but get some facts first. I think it is too early to hear from the company but if a jury trial in public takes place there will be an overload of information.

RR - Now you're being pythonesque silly. BTW the sun is about to enter a cooling phase, that may make your global warming a myth.

At the moment emotion seems to be ruling science, that will get us nowhere fast. There is more than one side to the climate debate. I prefer to make dispassionate personal judgements on all the arguments.
