If you are hoping for ODX to come out and fight its corner you are likely to be very disappointed, Covid has been a complete nightmare for Donkey, which he just wants to go away.

I recently asked them to show some evidence that ODX had acted in good faith even when behind the scenes the DHSC had dumped the contract, I asked them to confirm the date of the last "Constructive dialogue" they had with the DHSC, and whether that was after 1st October. because ODX even a month after the expire date were stating "We await a decision from DHSC as to which #COVID19 test we will manufacture."

Their response was they wont release any details of discussions with DHSC or any other party.

Basically everything that ODX spent (and can demonstrate has been spent) on providing the services (No differentiation is made between the phases) can be applied to the pre-payment funding, and based on the fact that ODX have stated they have spent their own cash as well, i would hope they have records for all the £2.5M

ABDX are not going to court with the DHSC over the outstanding payments, at present the DHSC have not contested that the amount is due, they have however delayed the payment and threatened to link the payment to the GLP legal challenge of the governments award of the contract

We haven't seen the UK-RTC contract but its likely to contain a similar clause as the ODX contract
